I have to say it certainly sounds like they have but I am no expert on GPL.
However, judging by the cost and product I think its future may already be sealed. To go head to head with Ensim and Sphera in my opinion is a huge strategic mistake, I would imagine Idaya has neither the financial backing or solid product to take on these guys. Again my opinion is that the original strategy of an open source project was correct and that Idaya did not wait long enough for adoption of the product before going commercial, freeVSD is hardly a household name and is hardly easy to use, anyone who has used Ensims product wil know how simple it is to add a new VS or set up a new host server Sphera has just won another $15 mil in backing for a product that hardly anyone uses and Ensims prices, when you negotiate with them, are lower than Idayas for a product which is better (root access, web panel, very easy deployment of new servers, etc) and doesn't make rash claims such as '250 servers per appliance' These again are just the opinions of one web hosting company director who did commercially use freeVSD - someone who would happily pay for add-ons (web panels, support, installers etc) but not for something which is GPL, someone who would be sad to see freeVSD disappear and someone who thinks Idaya made their move too early.
