Warning: The following horse has been probably beaten to death countless times. 

As far as I know, the incompatible requirements are the following:

 * 4. The names "project-name" and  "Apache Software Foundation"  must not be used to
 *    endorse  or promote  products derived  from this  software without  prior
 *    written permission. For written permission, please contact
 *    [EMAIL PROTECTED]
 * 
 * 5. Products  derived from this software may not  be called "Apache", nor may
 *    "Apache" appear  in their name,  without prior written permission  of the
 *    Apache Software Foundation.

If such is the case, the ASF could trademark "Apache" and the 4th and 5th requirements 
could be dropped. But [erhaps it is not possible to trademark the name of an Indian 
tribe. It seems to me that we are using copyright law to protect the Apache brand 
name, whereas trademark law could do just as well. I am sure the foundation has 
considered the alternatives and that there are very good reason for things to be the
