He says that his worm patched up the hole... although it DID install a
backdoor too. Was it criminal activity? Definately. His argument was that he
didnt have any malicious intent, but I think we all know the better....

Yes. :)
It was foolish and naive of him to think that doing a few favors for the FBI
would get him off scotch free. The FIRST thing he should've done was to seek
legal advice, then if he really did want to help the FBI, his lawyer
could've written up a contract or something else.
