An interesting "reverse" variant of this. A long time ago I had a customer negotiate a contract that said that if we went out of business that they would get first refusal rights on hiring one particular developer of ours.

Instead of escrow or source code supplied to an end user, I think it would be far better for folks to consider someone else to take over should a product be left behind (for whatever reason). For example, the code could be given or sold to Rocket/Dino/Serena/etc. and hopefully get some long-term support.
