Some lawyer could probably put together a "reckless negligence" charge against PC owners whose machines have been compromised. Just like driving your car "recklessly" with worn brake pads/low brake fluid, bald tires, no tail lights, etc.


Again, talking strictly about Lycos, we're not really talking about a
DDoS... but it's easier to refer to it that way.

It's the best acronym and description. No need to invent some other term.

It's a DDoS. To paraphrase the NRA, machines do DDoS's, not people. Whether the machine owner is willfully instigating or not is not part of the definition of DDoS.

And don't forget, the Lycos or any other such DDoS is not an offensive attack, it is a self-defensive COUNTER-attack.
