As a Sun licensee, unless their own JDK was developed in a clean-room environment so as to be free of any knowledge of the Sun source.
Even if it was done that way, the Sun license may prohibit licensees from releasing competing implementations.
However, if this is the reason, they could publicly ask Sun to waive it..
or 2. contribute to projects like GNU Classpath, GCJ, Kaffe, SableVM, etc.?
