Yes, they would be shut down under the current system. The hypothetical
proposed was "Imagine if..."
The definition of "Average [A]merican newspaper" is rapidly changing.
More and more people are getting their news from the Internet. Dead tree
papers all over the country are losing readership at often fatal rates
(including the Union-Tribune - but then that's not a real newspaper
anymore, so who cares).
Since anyone can publish on the Internet in the U.S., what's to legally
stop an Internet Newspaper from putting boobies on the "Front page"? So
far no government authority or court is effectively enforcing "Community
Standards" for what can be displayed on American computers (kiddee-porn
notwithstanding).
