I have followed this thread for quite a while before it got to the
Miata forum and have found it interesting. Interesting, since I am
not involved, but scary in that I have seen things all to similar
happening close to home.
I see this type of thing happening with power mad HOAs all the time.
And yes, I have a few real estate credentials and currently work in
the real estate field too Jim.
As a lender I find HOAs to be a major pain in the A$$.
As an Appraiser I find HOAs to be a major pain in the A$$
As a homeowner I find HOAs to be a major pain in the A$$
As a real estate broker I find HOAs to be a major pain in the A$$
My wife as a closer at a Title company finds the HOAs to be an even
bigger pain in the A$$ than I do.
Property values definitely do not increase faster with HOAs than
without HOAs in our neck of the woods - Texas, but I have heard that
in retirement type communities they do, but that's a different
situation entirely. As a matter of fact a HOA present can increase
sales times by a significant amount of time here.
The thing to remember here is that this guy is a renter so he would
not have been involved with any rule making. It is quite clear that
the Booters have vigorously exceeded their authority, or have they?
They can only do what the HOA allows them to do. If they were
exceeding their authority then the HOA would have stepped on them the
first time it happened to a member so there could be another aspect
working here. The big downside to a Townhome or Condo is that the
actions of other people determine your value and any perspective
buyer's ability to get financing and therefore your ability to
resell. If the condo association has (too many) special assessments
or too little in reserves, or too many renters then (good) financing
can become scarce or nonexistent which means that buyers cannot or
will not buy. They may be doing some rigorous enforcement to help
keep the rental % down and therefore protect values. You have to be
more vigilant in a Condo or Townhome than you do in a single family
neighborhood.
Then there's the fact that the Booter company owner appears to be an a
$$hat, which is typical in this type of company.

left out was the very important fact that the parking rules were
voted on and enacted by an elected representative board of
directors. Every set of by-laws has recall provisions. If a
majority are unhappy with the new parking rules, simply vote out
the board. Then elect a new board who will do away with the parking
rules. That's how representative government works. An HOA is
essentially the lowest and most basic form of government.

Larry, you are making it sound like the HOA and the homeowners are
two different entities. The HOA is the homeowners, and the
homeowners are the HOA. I'm cutting off your kool aid! ;-)

Not likely. HOAs are run by a board of directors elected by the
home owners. Like I said, it is all about choices.

Awww... c'mon Jim, this is kind of funny. If you read the whole
thing the parking enforcement company was actually in breach of
contract for overbilling. Yes, the home owner parked
incorrectly by not showing his parking badge properly. However, I
found great humor when he dollied the car into his garage and
offered the boots back to the agency while the actual police were
standing right there.
With this guy, the fact is that he bought the home in that
community because it was the only home he could buy in the entire
region.
Nice find BTW. The original thread on the forum that started this
got locked. I've been jonesing for an update all week!

People can choose where they want to live, or not. And real estate
developers can choose how they decide to develop their land, or
not, either with or without CC&Rs. It's all about choice.
The fact is, people buy homes in CC&R communities simply because
history has proven that homes in CC&R controlled neighborhoods
appreciate at a faster rate. See attached.
