Actually in most cases the HOA is never the homeowners. The HOA is a bunch
of elected people that get drooling power crazed looks on their faces and go
off on a witch hunt. Once they are elected they can and do pretty much what
they want until the next election. Unless it's some major issue that
requires a members vote they usually get to do pretty much whatever they
want in the meantime.

By state law ALL corporate associations - whether HOA or some other type of
association - have to be operated by an elected board of directors. I think
the OP is conveniently leaving out important bits of the story.

Could be true. No reason to doubt the OP.

Could be also true. No reason to doubt the OP. However, what he left out was
the very important fact that the parking rules were voted on and enacted by
an elected representative board of directors. Every set of by-laws has
recall provisions. If a majority are unhappy with the new parking rules,
simply vote out the board. Then elect a new board who will do away with the
parking rules. That's how representative government works. An HOA is
essentially the lowest and most basic form of government.

Larry, you are making it sound like the HOA and the homeowners are two
different entities. The HOA is the homeowners, and the homeowners are the
HOA. I'm cutting off your kool aid! ;-)

Why would you doubt that a HOA would do something like that without the say
of the homeowners?

Not likely. HOAs are run by a board of directors elected by the home owners.
Like I said, it is all about choices.

As the home owner stated several times, when he bought his home, there was

I wish him well.

Awww... c'mon Jim, this is kind of funny. If you read the whole thing the
parking enforcement company was actually in breach of contract for
overbilling. Yes, the home owner parked incorrectly by not showing his
parking badge properly. However, I found great humor when he dollied the car
into his garage and offered the boots back to the agency while the actual
police were standing right there.

With this guy, the fact is that he bought the home in that community because
it was the only home he could buy in the entire region.

Nice find BTW. The original thread on the forum that started this got
locked. I've been jonesing for an update all week!

Totally bogus home owner.

No one HAS to live in a CC&R community. It is still a free country. People
can choose where they want to live, or not. And real estate developers can
choose how they decide to develop their land, or not, either with or without
CC&Rs. It's all about choice.

The fact is, people buy homes in CC&R communities simply because history has
proven that homes in CC&R controlled neighborhoods appreciate at a faster
rate. See attached.
