So Platt, you are accepting a static social pattern the authority to
say what is illegal. I'd agree with the pragmatism, but not the
certainty over the legality of their authority.

That authority is a matter of social convention (not necessarily a bad
one, in fact a damn good one) but not any kind of certainty.
