Using Ms. Gallagher's line of thought, here are some other
possibilities:

If a bar owner chooses to have only white people in his/her bar,
employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to have cockroach and rat infestation in his/her
bar, employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to serve e-coli contaminated food in his/her bar,
employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to have no emergency exits in his/her bar,
employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to have contaminated water in his/her bar,
employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to have overflowing toilets in his/her bar,
employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to serve women only in bikinis in his/her bar,
employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses to have no fire suppression equipment in his/her
bar, employees wish to work in that environment, and patrons chose to
patronize this particular bar...that is their right and government needs
to butt out.

If a bar owner chooses not to require glasses and mugs be washed between
servings in his/her bar, employees wish to work in that environment, and
patrons chose to patronize this particular bar...that is their right and
government needs to butt out.

All of these are issues that have come in front of city councils or
judges concerning the "rights" of bars to do as they please!  

Bars are however, licensed and regulated establishments that have to
conform to certain rules and ordinances of the community in which they
do business!  A city has the right to restrict where smoking is allowed;
a city has the obligation to protect the public health!

Smoking tobacco in a public place is not a right! Like drinking alcohol,
driving a car, dancing naked, riding a horse, hunting or fishing, using
your boom box, or throwing out your garbage, smoking tobacco can be
restricted to certain places!

Clean fresh air/water should be a right for all.  However, if a bar
