There is a *VERY* simple way for companies or individuals to get around this.  If you 
have a lawyer then seal and date, in the presence of said lawyer a copy of the CD and 
get them to keep it in their storage vaults.  Then, if you ever need to prove the CD 
company damaged thier copy, invite their lawyer around to yours and get him to open 
the signed and dated envelope with the CD.

Alternatively - and this can (and Should) be done with anything that is even slightly 
legal bound (For instance I did this when my flatemate asked to borrow �300) - Send 
yourself a copy of the CD (with a letter inside explaining what it is) through the 
post - recorded delivery if its possible.

And leave the letter/package *Unopened*.

That way, if you ever need to resort to lawyers or whatever you can take the Unopened 
letter/package along and open it in their presence.  It will have the Royal Mail Date 
Stamp on it, and if it was done recorded, there will be a record of it at the post 
office too.
