Firstly I might have over stretched some points in the past. I do not think that PI in 
non published (or limited distribution) titles is an issue, but once a product has 
been fully publihsed then the PI within it needs to be protected.

If it is not protected then the whole process of creating OGL material will become 
much much more expensive because the only way that you will be able to protect your IP 
will be to apply for a trademark (or similar) i.e. you will have to rely on existing 
laws rather then being able to use the simple PI rules as defined in the OGL.

This will be a great shame.
