The dirty little secret is that you DON'T have to point to the PH. You can
point to your own OGL'd work that includes character creation, or some OTHER
book (like, say, *STAR WARS*) that does the same.

Wild West game changes:
1: Create firearms.
2: Create new classes, all of which have LOW hp advancment, if any (say, a
fighter could have 10 at first, their con bonus, and then only 1 extra per
level. In ability score descriptions, say "HP bonus adds to HP at first
level only.")
3: Tweak the feats, if desired.
4: Write up a new skill list, having "name" skills only as those that are
relevant (for instance, you'd take out "Spellcraft" and "Alchemy" as
seperate skills.)
5: Write up examples of combat empahsising cover, speed, and dexterity.
6: Think up catchy name.
7: Sell game to support gaming habbit.
