The d20 SRD has NOT been released under the OGL.  However, permission has
been tentatively granted to use the d20 SRD to make OGL and d20 products,
with the understanding that those products may have to be revised when the
final d20 SRD and d20 STL are released.

This is pretty much the same state as the WotC online policy - we won't sue
you if you use it, but we aren't giving you any legal standing to use it
either.  It is actually better than the online policy in that WotC intends
to grant legal standing to use the material at some point in the near
future, which is part of their motivation for allowing it to be used now.
