I disagree with your analysis.
Take Dragon Magazine for example. A 3rd party pubisher who wanted to
produce Dragon Magazine, and replace all the "D&D" content with Open Game
Content derived from the System Reference Document could do so easily.
Sure, they might have to write to WotC and ask for a letter providing
permission to run reviews or editorial comment if they wish, but that would
be the extent of the problem. Heck, they could even use the d20 Trademark
on the magazine if they opted to just forgo articles about character
creation and level advancement.
Not only do I think it is possible, I believe (based on my inbox) that it is
a virtual certainty that there will be more than one d20 focused magazines
avaialble in the new year.
