NO.  You can implement the entire SRD, _not_ the D&D 3e rules.  Anything 
not in the SRD must be original (or non-infringing).

You can use any spell names that appear in the SRD.  This is _mostly_ 
what's in the PHB, but some names have been removed (like Mordenkainen).
