Mostly yes, but be careful when you say "entire D&D3e rules". You don't
have the rights to the entire D&D 3e rules. You only have rights to what
Wizards has put in the SRD. They are nearly identical where they overlap,
but the SRD does not grant permission to use the D&D 3e rulebooks as Open
Gaming Content.

Short Answer: If it is in the SRD you can use it. If it isn't, you can't.
Long Answer: The SRD is currently in two forms. The officially released
section (8 sections really) on the Wizards web site, and the unofficial
version that Ryan has been posting for comment on the OGF web site. All of
the d20 products you see on the shelves right now are actually based on the
unofficial version, under a 'gentleman's agreement' that those works would
be modified if, once the entire SRD becomes official, changes must be made
that invalidate the prior third-party work.
The official version is the only one you can count on. The unofficial
version is supposed to go away Real Soon Now. Once that happens, most of
the confusion about what is or is not in the SRD should go away.
To answer your question about spells- they are part of the unofficial SRD
right now, and are expected to be part of the official version in the near
future. Other things that are part of the unofficial version include all of
the PC Races from the PHB, the PC and NPC classes from the PHB and DMG, the
Prestige classes from the DMG, all of the skills & feats from the PHB, all
of the creatures from the MM, and all of the magic items from the DMG. The
descriptions of these items are abbreviated from what you will find in the
core books, so don't go typing in things from those books and expect them to
be the same as the SRD.
