My point so many months ago can be illustrated by the following
example.  Some producer puts "frost" in front of every monster
in the soon to be OGL'd portion of the MM and designates all
those names as PI.  All the monsters are changed to a white
color and some have a breath attack.  If someone else comes along
and writes an arctic adventure with "frost" monsters and white
coloring or breath attacks then it would be good for the community
to have the bogus claims ignored.  And yes it would be a risky
thing to do because there are clearly people who think they have
a legitimate right to such bogus claims and will take you to court.

Of course, if they feel it would be financially better to just go
and stake out every soon to be OGL'd feat with the word "improved"
in front, they might be too busy.  Either way they have spread
enough FUD that many people will be reluctant to produce anything 
that might compete with one of their products.  

Note that I do not think ANY producers on this list might do
something like that.  Even though I think some of them would be
happier if people didn't participate in open gaming as anything
more than a consumer.
