No. Nobody else can derive from that particular work and use that PI, but if the 'new' creature is based on public domain prior art then you can both create your own version of it and not be in violation. You just won't be able to use anything based on his work with your work. I see this as the real danger of indiscriminant PI - incompatible chains of derivation.
