well, first, you could easily include chargen rules, and all that 
rot, by using the D20SRD via the WOGL, but not slapping a D20 logo on 
it--then you don't have to abide by the restrictions of the D20STL. 
second, there's the potential loophole in the D20STL of referencing a 
non-OGC, non-D20, product that has character creation rules.  third, 
"classless" is easy--just set up a game that only has one class, with 
lots of flexibility in skill and feat selection, and put any "class" 
powers that you want to keep into the feat or skill systems.  you 
could probably even manage it under the D20STL.  as for level-less: a 
friend of mine is working on that.  a cyberpunk RPG based on D20, 
and, much like the CP2020 system, classes might survive, but levels 
probably won't.  there are numerous ways to manage that with D20, 
some of them quite easy.  i'd have to think a bit to see if any of 
them are possible under the no-advancement-explanation rule of the 
D20STL.
