I am not sure this is the case:

Here is OGC (hypothetical):"Mind Flayers resemble exposed, oversized 
human brains which scurry about on eight segmented limbs. The front of 
the brain contains a lamprey-like mouth surrounded by tentacles."

Now, a thousand artists can draw a thousand pictures based on that, and 
declare each *individual* picture to be closed content. What cannot be 
done is prevent any other artist from drawingf a similair picture based 
on that idea. There will be no 'character copyright' on this concept of 
the 'Mind Flayer'.
