Except people who are for some reason absolutely sure that they won't be
running on pre-3.5 devices, who would have to put useless icons in their
PRC to satisfy the tool.  (For example, vertical apps where they provide
the device with the software preloaded... or apps in the rom...)

I'd suggest a warning, but not a hard-coded requirement.
