If it was purely legal they would do it above the table, installing a tap 
inside the data center themselves. They don’t, and most companies would find 
that a wide overreach.

Encrypting the links that transport lots of private data to faraway places look 
like a reasonable practice. But it is one of many possible solutions. It may 
well be more practical to use a form of end-to-end encryption between the 
components of the data centers. See classic debate on end-to-end versus 
link-by-link, in which end-to-end tends to win most of the time.
