After having a major argument with a building owner in Birmingham , who
lay claims to land they didn't own, I then got the council diagrams form
the highway department to prove it to them. Um very humbled bulding
owner. I got loads of abuse from security guards on public highways land
etc. The local council were appauled a a few heated phone calls were
made by them as the person was a keen amateur photographer. I threatened
to sue for harrasment ( on principal) and assault and the tune seems to
have changed, well I havent tried recently anyway.
The section 62 of the copyright law covers this
Representation of certain artistic works on public display.
62.-(1) This section applies to-
(a) buildings, and
(b) sculptures, models for buildings and works of artistic
craftsmanship, if permanently situated in a public place or in premises
open to the public.
(2) The copyright in such a work is not infringed by-
(a) making a graphic work representing it,
(b) making a photograph or film of it, or
(c) broadcasting or including in a cable programme service a visual
image of it.
(3) Nor is the copyright infringed by the issue to the public of
copies, or the broadcasting or inclusion in a cable programme service,
of anything whose making was, by virtue of this section, not an
infringement of the copyright.
So bog off. This also applies in european law, now as the copyright laws
have been homoginised. So as I understand it the need for a building
release in france may be now iilegal. Not sure how true though.
Though I may be wrong.
If you get abuse about where you can and can't from an over zealous
security guard then, contact your local highways department who have up
to date maps, which have to issue by law to you, or if your sure, then
phone the police, who came down and decided I was being reasonable, the
secrity guard was being unreasonable and told him to back off, rare I
know.
