Let the carnival of politics begin Author: Rajesh Singh This year’s Assembly poll in Goa is marked by the presence of unconventional and colourful candidates Conventional wisdom says: Too many cooks spoil the broth. But clinging to conventional wisdom will become an obstacle for those who wish to understand the politics of Goa and enjoy its roller-coaster ride. So, tie your seat-belts, leave logic aside and have fun as the voters of the State prepare to elect their 40 representatives from a large and colourful bunch of candidates to the Assembly on March 3. Because, in Goa, ‘the more the merrier’ rules the ballot box more than anything else. The battlefield has the more known faces who have been returning again and again either to retain seats or win them. But there are also those who are untested and new to electoral politics. So, rubbing shoulders with hardboiled political veterans like former Chief Minister Manohar Parrikar and incumbent Chief Minister Digambar Kamat is the greenhorn Father Bismarck Dias, a Catholic priest who will now issue sermons to the voters on good governance and confess to his desire to be an MLA. But banish the thought that he represents the powerful Catholic Church as its candidate. The Church does not need to be heard in the ordinary portals of the State Assembly when it has a direct connect with the Good Lord. Never mind the fact that the Church has played a more than spiritual role in the recent past, dabbling in all sorts of agitations — the anti-Konkan Railway movement and the emotionally-charged and at times violent protests to make Konkani the sole official language of the State, being just two of those — that had a political tilt. Fr Dias has been fielded by a clutch of social organisations which believes that a great deal of social good would be done if one of its own sits in the hallowed precincts of the House — now housed for some years in a glittering new complex across Mandovi river in Porvorim, a stone’s throw away from the capital town of Panaji (or Panjim). Even before he wins or loses, he has created a record that even the Church would be proud of: Fr Dias has become the first Christian priest to contest an election in the State. Amen! At a more material level, it makes sense for the priest to throw his hat (or the robe) into the electoral ring. The non-Government organisations have been for long having a field day in Goa because, tiny though the State is, it is filled to the brim with people dissatisfied with a range of issues — from political to civic to social. The NGOs believe that the citizens who have vociferously backed them on their various movements would now, as voters, put their votes where their mouth is. The State waits with bated breath, and Fr Dias will do so almost breathlessly, for the outcome of the poll. Of course, few expect the NGOs to win enough seats to mark their presence in the Assembly, but political parties are still wary because the candidates being put up can eat into their votes enough to make a difference between victory and defeat. One shudders to think how dull Goa’s politics would have been without the likes of the bandana-sporting Mickey Pachecho, former Minister for Tourism and now chief of Goa Vikas Party, an outfit that he has floated after being ousted from the Cabinet over allegations of his involvement in the mysterious death of a female friend. He has in the past briefly flirted with the BJP and been with the Nationalist Congress Party. He will be remembered for the infamous quote that he allegedly made: Goa has become the rape ‘city’ of the country. Nobody remembers him for any substantial contribution that he may have made as a Minister or politician — though to discover that achievement would in itself be something of an achievement. Yet, he is crucial to maintaining the breezy image the State’s politics has. In this election, though, he is poised to play the spoiler for the Congress. Mr Pachecho has a fan following of considerable size in the southern belt of Salcete taluka dominated by Christians, who have traditionally been Congress voters. It is also a region that has seen the maximum amount of vote divisions among smaller outfits, which has denied the Congress the sweep that it ought to be making, going strictly by the taluka’s demography. By default, then, the BJP could be the beneficiary. The Congress may consider him a baggage that has been well rid of, but the party has burdened itself with another kind of baggage in the form of the portly Jitendra Deshprabhu. A landlord of some stature, he owns an acid tongue that has singed many an opponent of his. For some reason he suddenly left — or was compelled to do so by circumstances — the Congress and joined hands with the Nationalist Congress Party to unsuccessfully contest the Lok Sabha election. Sir, FN's request for help in 'learning' Konkani is a shocker. Have we Goans 'forgotten' our maim-bhas? It is not surprising.as time and time again I have come across Goans who, when questioned reply' I dont speak it, but do understand it' My personal experience is that almost all nationalities are bilingual, always talking to their acquaintances in their own language, except Goans who very rarely speak to other Goans in Konkani. Its almost as if they are ashamed of their own language! They often point out to non-Goans that they are NOT Indians! They will say we are Goans, but rarely speak their Goan language, Konkani. Especially the overseas settled ones. What a sad state of affairs. I still speak Konkani which I leanrt from my granny mum, now passed on, and I am proud that I can do so! I must admit I am guilty in one respect here.I have not taught it to my children, who had been in boarding schools in their formative years. I am unable to help FN as regards books and other aids to learn /teach our language. Bit confused reading the Valanka Alemao website, www.sunrisevalanka.com. It says she is general secretary of the GPCC or is one of the secretaries. she says she is also spokesperson of the GPCC and member of the manifesto committee. Newspaper reports says Vijai or Vijay Sardesai is the general secretary. If Valanka is the spokesperson, how come she has not uttered a word on behalf of the party? It is either Vijay or Subhash who are making official statements. In an ad by Churchill and Valanka welcoming Sonia Gandhi to Goa, Valanka was described as general secretary. Dear Roland Thanks for your post and acknowledging my spousal devotion which is to such an extent that I volunteered to stay at home to look after our pets. On the subject of wifely duties, I am not sure if you have seen this book The proper care and feeding of husbands by Dr Laura Schlessinger. No, it does not contain any Goan receipes yet, but is a highly recommended book to leave in strategic places around your home. When I first purchased this book and dived into the middle of it to read a few paragraphs, I thought it was a reprint from the 18th century. Imagine my surprise to discover it was written in 2004 and is the international best seller. Here is a taster from this book. Dr Schlessinger has included part of a letter from Chris (a man), to highlight important words of wisdom to us (women): Quote: If I had to summarize, I'd say, Please, ladies, recognize that we men do love you, and although you may not think we do much around the house, we do the ugly stuff like change the oil and mow the lawn and get up early when it snows to shovel a path to your car and start the car so it will be warm when you get in. We would walk through fire for you to get you a quart of cookie-dough ice cream in the middle of the night, because we love you. Unquote While contemplating what was the best time to meet you and your wife in Goa, our postman delivered the January 2012 issue of Goa Today. There is an excellent article on page 11 by Nicola De Souza in the Guest Column (based on this article alone I recommend she be promoted to the Permanent Column). In this article she describes the work of a voyeuristic waiter, a fictional character called Chintoo who came down from a small town in India to Goa and decided to stay. His hobby is photographing what he feels is worth photographing on the beach (I will leave this to all our imaginations). In the last part of the article, this is what Chintoo says My wish for 2012 is that more and more of my brothers from across the length and breadth of India come down to experience Goa at least once. We will scourge the beaches (fully-clothed of course) and go home each night (even if alone) to a bounty of bottoms and bosoms. Culture vultures, don't try to stop us. Have Camera. Will Click. This time, it is on the horrendous crisis of water scarcity and growing threat of water pollution in cities. I believe this report's analysis will be crucial in building a movement for a water-secure India (and the world). We know that India will (as will the rest of the world) continue to urbanise. It will implode, which will put pressure on scarce water resources. And if we do not get the arithmetic of water-waste correct, it will also drown in its own excreta. It is also clear that we in the growing parts of the South do not have the financial capital or natural resources to be able to ape the systems of the already industrialized world cities. We know that we have to urbanise, but we must do so differently, so that we can build cities that are water-prudent and waste-wise. How is this possible? This is what we have detailed in the two volumes of our report – *Excreta Matters*. The first volume dwells on issues of water supply, groundwater, sewage and why we are not managing to clean our rivers and lakes, in spite of pumping in money and new technologies. It joins the dots between pollution and our flush toilets – between the river and the cities’ infrastructure to provide water to all and take back the waste of all. It then sets out to explore the management challenges – from the issue of private sector involvement to the matters of economics of water and waste in cities and what needs to be done to build a different future. The second volume is even more comprehensive. It presents a city agenda – city by city. We detail the water and waste stories of 71 cities: we ask where their water comes from, and where does the waste go. Putting together this apparently simple answer has taken us a huge amount of research. It is indeed appalling how little we know of our own realities. We hope you will take the time to read these reports. We need you to join us in understanding that the challenge of water and pollution is not about money or infrastructure alone. It is about building a new approach to urbanisation and growth that is affordable and sustainable. The story of water and excreta tells us how this can be done. The report is available with us. Dear goanet readers Following my article a while back on goanet on Konkani amchi bhas, I am pleased to hear more and more of it being spoken over the last few weeks. Contact, the magazine of the Goan Chaplaincy in the United Kingdom, published my article and during the social, after Konkani mass on Sunday, I heard several youngsters talking in Konkani. This is all positive news, a move in the right direction. The other day on a visit to my mum I said it would be nicer if she greeted me saying kai bori dista instead of have you put on some more weight? Here is perfect example when translating Konkani into English, it loses all its meaning! This goanet posting is really to say a big thank you to two of our community who have contributed most to my continued learning of the language over the past few weeks. Firstly, Rene Barreto for his link into Petition to include Konkani in the list of languages on Facebook. Postings here are are in small bite size pieces of Konkani which are so useful for someone like me. Seeing long postings of Konkani on goanet leave me quite overwhelmed thinking will I ever learn to speak, read or write this language that I love. It is like purchasing a sewing machine and your first project is to sow a wedding dress for your best friend. Secondly, to Eddie Fernandes for a link on Goan Voice to hear The Three Divas sing. This video has had a number of hits from me alone, while working my way through boxes of tissues, wiping tears of joy. Dear Manohar-bab, Floriano is a 'doubting Thomas' and always skeptical regarding your ambitions, claims and promises. He is also skeptical of the viewpoints and claims of every political party, organisation and individual other than himself and his little group. But of course if anyone so much as questions any of Floriano's claims and beliefs he gets into a tizzy. Floriano's intentions are the best but his over-ambitious attitude and bull headedness in the face of even the slightest criticism has led to his being routed in every election he has contested. His attitude has even often resulted in his (party's/group's) candidates personal goodwill being eroded in their own constituency. For example Julius Pereira has a lot of friends in Aldona who might have voted for him, but the fact of him being 'supported' by Floriano will work against Julius rather than for him. A big thank you Our Lady of Valankanni It was six and half long years since we were married and not blessed with a child. All these years we were longing for a child. We went to all doctors in Goa and also in Doha where we both are presently working but nothing worked out in our favour. All doctors said to go for IVF which according to them was the last option left for us. Finally, we gave up all the hopes and decided to go to Valankanni, Madras during Novenas. It took 3 days to travel up and down from Doha. We forgot all our pains we went through all these years and prayed to Mother Valankanni with full faith. Lot of devotees goes there to offer their offerings to pay the favours they have received. After seeing the devotees, our faith increased and we both had a rose petal which was offered at Her Feet and prayed to Her to take away all the obstacles that's comes in the way to give us a child. It was very peaceful all around. The next day we went for Novena mass which was in our mother tongue Konkani and prayed with our hearts out. In the same month we had planned our vacation back home and accordingly we proceeded for our leave. While we were in Goa, we came to know that we are blessed with a bundle of joy by Mother Valankanni. This was the biggest miracle in our life. All are pains and sorrows turned into joys and our family was also very happy as we were the only ones waiting for a baby. We cannot express the height of our excitement and this is all because of Mother Valankanni. She is our Mother who understands all our pains and always there to helps us. We have seen the number of devotees at Her feet who have different problems and how they stay there away from their home for novenas. This is all because SHE is very powerful. [Goanet] ON WRITING AND DELIVERING JUDGEMENTS
Temples of justice are the ultimate hope for those in quest for Justice. In recent years we have some outstanding young judges appointed but with no transparency and accountability in the selection process over the years some judges lacking legal acumen have also creeped into the system. We have some judges in the subordinate courts who even after a decade of donning that position continue to display their sheer ignorance of law and legal procedures coupled with utter gross arrogance. Sometimes only after years such judges are sacked or compulsorily retired. But what about the damage they have done to the institution by dispensing injustice through their poor judgments during those years they held office. There is no clear cut formula for writing a judgment. In the writing of a judgment the supreme virtue for every judge however should be clarity and precision. Nobody being above the law, judges should while dispensing justice be blind to the social status or financial standing of the parties to the litigation. Caste, creed and other considerations should not be taken into account except the Rule of law. Judgments cannot be tailored to benefit the rich, powerful or the influential. There should be consistency in the manner in which judges interpret the law. Under no circumstances can Courts be casinos where the litigants gamble their luck to secure favorable orders. Some judges may regard it as derogatory, to have to listen to a subject on writing judgments which they consider themselves to have mastered. However as the subject goes to the very core of the judicial function it is an issue worth debating. A judge while battling with varying facts of the various statutes involved and the differing perceptions acquires skills of his own. Eventually, it is experience that enables the judge how to go about the job. There are gifted judges who stand above others in writing judgments. Judges whose judgments are too brief shift the entire burden of giving reasons on the appellate Court. Some of these judges glorify their disposal statistics. The percentage of appeals filed against their judgments and how often they are reversed is apparent. Quality can never be sacrificed for quantity. The foremost duty of every judge is to deliver a well reasoned judgment. There are also some other judges who err on the other side by their lengthy and confused judgments. Some training needs to be given to newly recruited judges so that they can write lucid and rational judgments with clear cut findings. At the start of one’s judicial career some judges rightly adopt the traditional way of writing judgments. Years of experience and a little innovation can improve the quality of their writing. Some judges reproduce the entire pleadings page after page, in their judgments, extracting the contents of each document and then reproducing the entire evidence. There is no way of knowing how the conclusions are reached. It is expected that the Judge gathers the relevant pleading, documentary evidence and oral evidence under each issue and draws his conclusions. That is what makes a good judgment. The quality of a judgment depends upon the quality of arguments addressed. But an incomplete or inartistic argument of a lawyer is no excuse for producing an unsatisfactory judgment. Judges have a moral and legal duty to make up for the shortcomings of the lawyers who argue before them. A certain minimum amount of research by the judge is needed. In the past lack of a good law library at home or even in the Court was a handicap for the judges in the subordinate courts. Today most courts have a law library and even personal libraries for the judges. No judge should think that the sheer length of his judgment or its physical weight will be an index of quality. The quality depends on the presentation of facts, discussion of the issues of both fact and law and the quality of the reasoning. Judgment-writing is indeed an art. There are judges who are highly technical in their approach and have no mind for justice. At the other end of the spectrum are those whose sense of justice totally overrides the bounds of law. Both these paths are unacceptable. The Judge must always try to render justice but that does not permit him to transgress the limitations of the law. Drawing the line is not normally difficult except in very rare cases. It is said that judges have their own personal pre determined view on various issues. It is presumed that some judges are pro-landlord or pro-tenant, pro-individual rights as against community interests, or pro-women/children as against men, pro-labour or pro-management. No doubt judges are human and their family background, education or environment may influence their decision-making process. This cannot be helped. But over a period, the judge must detach himself from these fixations and keep the oath of his office in mind and decide every case strictly in accordance with law and the set principles of justice.
