I am using the name GIMP and the image of Wilber in my podcast Meet the
GIMP at http://meetthegimp.org. As far as I remember I asked here and got a

Personally I am totally fine with you promoting GIMP and find it hard imagine 
anyone being against that.

I don't know, but since it's installed it is in the source, and if it is in the 
source you can find out the author by looking at the file history in git.

That's a font, I think the name is Wide Awake but I'm not sure. Someone 
probably remembers.

Don't you think there is too much confusion, problems and hold
on to use one or two free as in speech images in an open source
project ? Personally, I think there is no need to bother with such
nonsense and simply act freely. Otherwise there can't be even talk of
anything more than free as in beer.

To clarify the issue here, some names, such as PhotoShop and Linux, are
trademarked and require permission in order to be used.  Gimp, however, is
not trademarked, so no permission is needed.

I agree with you, personally I wouldn't take any issues at all if he used the 
images in a reasonable way (such as giving credit to GIMP).

Since he asks for permission though I assume he cares a lot about not violating 
any licenses, and since he wants to distribute in CC but the image (when 
distributed with GIMP) is under GPL, he has a problem, strictly speaking.

But again, taking legal action would be insane IMHO.

Interesting -- I did a search for Gimp trademark and didn't find that.
But is there any evidence that Gimp is actually trademarked?  Unlike
copyright, trademarks are not automatic -- they must be applied for and
approved.  They must also be actively defended in order to be enforceable.

IIRC that page is a satire of the trademark page of another
program. So take it with a grain of salt.

I believe that the GIMP logos are licensed under the GPL.  If you wish
to have them relicensed as CC then you could speak to the author of a
particular logo.  I am not sure about compatibility with the Free Art
License.

According to http://www.gimp.org/about/linking.html , the provided  
images of Wilber, GIMP's mascot/logo, can be copied freely. My  
interpretation of this (which carries no authority whatsoever) is that  
there should be no problem with your usage of the Wilber image as long  
as it is being associated with the GIMP project.

As far as precise, formal licensing terms are concerned, the Wilber  
artwork was initially created by Tuomas Kuosmanen  
(http://www.tigert.com/) and he should probably be contacted for such  
information.
