So in this instance we sought advice from both Legal and Communications
about some of the ideas that we were proposing and from their feedback we
took the banner in the more conservative direction to give us clear ground
between us and any potential intellectual property issues however

been showing just one banner impression to 5% of anonymous users (excluding
the 5 countries where banners ran in December: US, UK, Canada, Australia,
and New Zealand).

ran banners at the end of 2012. WMF is not showing banners in those
countries.
