While it might be true today that the behavior is the determining factor in
determining whether a firm is a "monopoly", the justice department has been
inconsistent in how it interprets the anti-trust laws; at some times they
have prosecuted form (usually based on market share or some slightly more
complex test), and at other times they have prosecuted behavior (ATT was
for years OK because they didn't 'act' like a monopoly.)

Exactly.  And as far as children are concerned, supervision is always a
