-Caveat Lector- Utilities fought attempts to boost power supply, monitoring in '90s BY CHRIS O'BRIEN Mercury News The state's three largest utilities blocked attempts to build more power plants six years ago despite a key state commission's prediction that they were needed because California's demand for electricity would begin to soar. At the time, the utilities called those forecasts of increased demand -- since proven frighteningly accurate -- outrageous. They appealed to the federal government, which overruled the state's efforts to increase the supply of electricity. To settle their dispute with the state, the utilities then chose to pay energy companies more than $100 million not to build new plants. That battle was fought primarily by Southern California Edison and San Diego Gas Electric Co., which insist those plants would make little difference in the present energy crisis. But critics -- and even one PGE Corp. executive -- say that, if those 1,400 megawatts had come online in 1998 as planned, they would have eased the current energy crunch. But the impact of the utilities' actions also goes well beyond the loss of that electricity. The battle over those plants derailed the state's process for monitoring energy needs and for ensuring that enough power plants are built. When demand did surge, it was no one's job to pay attention. And by the time the state's process for approving new power plants got back on track after deregulation in 1996, the state had already fallen too far behind when shortages began forcing rolling blackouts last month. ``San Diego Gas and Electric and Edison went out of their way to make sure these plants didn't get built,'' said Jan Smutny-Jones, executive director of the Independent Energy Producers. ``If those plants had gotten built, they would be making a significant contribution to keeping the lights on in California.'' President Bush and energy companies are fond of saying that California failed to build any power plants for more than a decade because of red tape and out-of-control environmentalists. Closer to home, the three big utilities try to deflect blame by claiming there was a surge in demand for electricity that nobody could have predicted. Neither claim is true. California stopped approving major power plants projects in 1986 after a flood of them were built in the early 1980s. In addition, during peak demand, the state could buy as much as one-third of the power it needed from its more sparsely populated neighbors such as Arizona. But by 1992, the California Energy Commission, the agency that licenses and approves new power plants, saw those conditions changing. Population in neighboring states was rising fast, leaving less electricity to sell to California. And, with projections that the state's recession would end in the mid-1990s, California's population and economy were expected to boom in the latter half of the decade. Energy forecast The agency's 1992 biennial forecast of the state's energy needs projected that peak demand for electricity would grow from 47,813 megawatts in 1995 to 58,864 megawatts in 2000. Two years later, the commission revised its 2000 forecast downward to 55,819 megawatts. The state's actual peak demand for 2000 turned out to be 54,110 megawatts. ``We felt those were conservative estimates at the time,'' said Claudia Chandler, an assistant executive director at the energy commission. ``In the five-year time period, we expected to see an average growth of 2 percent each year. That was taking into account energy efficiency and population growth.'' The commission passed its forecast to the California Public Utilities Commission, which regulates the state's utilities. The PUC's analysts crunched some numbers and determined that the three utilities would need an additional 1,400 megawatts by 1998. Law aimed for competition Under a 1978 federal law intended to spark competition, the PUC decided to require the utilities to contract with independent companies to generate the power. Those companies then would build enough plants throughout the state to supply the projected shortfall. The utilities vigorously objected. ``Edison does not need any additional power until at least 2005,'' John Bryson, chairman and CEO of Southern California Edison Co., wrote in a 1994 letter. Besides believing extra power wasn't needed, the utilities didn't want to sign long-term contracts because deregulation was around the corner. And they opposed the auctions the PUC set up to award contracts. Under the rules, some of the contracts would be awarded to generators who would sell environmentally friendly power, which would cost the utilities much more. In 1995, San Diego and Edison appealed the PUC's auctions to the Federal Energy Regulatory Commission. Pacific Gas Electric Co. did not join in because it was in an awkward position. A PGE joint venture had won several contracts to build power plants in San Diego and Edison territory. A

The Catholic Church formula was to take all the money and possessions of anyone who used plants to have independent religious experiencing. The authorities forcefully insisted that life must be lived within the total framework they provided, mentally, experientially, and economically. To live outside that framework and to have religious or philosophical experiencing outside that framework was to break the law, which the church liked because then they could gain all your possessions and money. Science, democracy, and the renaissance were largely rejections of that sort of authoritarianism and forced hierarchical government which could treat people as having no rights and no property rights. America was founded on the principle of no martyrs, no victims of government campaigns, of inverting the power relation and rights-relations of citizen and government. The government exists to serve the people; the people do not exist to sustain the government. Property belongs to citizens, not to the king, pope, or governmental hierarchy, nor to the police/guard/soldiers. We need a better understanding of persecution by the church. People think it is about belief and doctrines at bottom, but as far as the power brokers in the top of the Church hierarchy is concerned, it is purely about worldly money and the power of money and the power to accumulate more money. Ultimately, the Church didn't directly care what people *believed*, but rather, what happened to the people's *money*, which was directly affected by people's beliefs. The police love druggies and hope for lots of them, because every identified or accused druggie means another property and batch of money to seize. The police-authoritarians love accused druggies for the same reason the Church-authoritarians loved accused witches -- these demarcated "devils" or boogiemen give the authoritarians the green light to take all the wealth which the person has accumulated, without the person having any recourse. The person is sent to hell either way, or some other realm, from which the person has no power to stop the authorities. Whether the person marked as a damned one is sent to jail for a long, long time, or killed and sent to hell or heaven or purgatory, it's all the same to the authorities' bank account: the person is removed, and their wealth is freed up to be confiscated by the authorities. It is crucial that we study the similarities between confiscation of the property of plant-using people (branded as "witches"), the Boston Tea Party, and forfeiture in the War On Drugs. These are all about the exact same thing at the core. I want to emphasize this above all: it is not an accident that the WOD is covered by the Boston Tea Party; or that drug use is covered by religious freedom. America was not started to prevent things *like* the war on drugs, it was started and the constitution and bill of rights were created to prevent specifically the war on drugs, not to stop things *like* the war on drugs. The Bill of Rights was not created to prevent this *sort* of thing; it was simply and frankly designed to stop this *very* thing. The WOD is not accidently covered by the Bill of Rights; the Bill of Rights was meant to stop the WOD and also other things like it. The Bill of Rights was crafted and designed expressly to block exactly what is really going on at the heart of the WOD, this dynamic of people being victims of arbitrary searches and seizures of contraband, money, property, wealth. Problem: authorities wield power to pillage and confiscate anything they feel like; all possessions potentially are the property of the State, on excuses so flimsy and accusations so vague, in the final analysis, no excuse or accusation is needed at all. Authorities see something they want, and they take it; this is complete and blatant government anarchy. Solution: restraints on government. The foundation of America is the idea of restraint on government to prevent arbitrary persecution, persecution which is most perfectly represented by the war on drugs, the war on contrabands, the war on alternatives to the governmentally enforced lifestyle and worldview. Such governments only permit one worldview, the one which causes all wealth to flow their way. If you adopt a worldview which doesn't willingly send your flow of wealth in the direction of the authorities, then they take your wealth against your will, by force and by fiat. Part of the strategy the authorties must use is propaganda designed to coerce the will of the citizens, the will of "the governed". So we see manipulation of beliefs and encouraging a sense of respect: respect for the King, for the Pope, for the police, for the media. Sure, many

Gephardt is a real commedian, but I'm afraid Dubya is not really into all that reaching out he talked about before he was selected. Bush, who was installed as president after an unprecedented and anti-democratic intervention by the US Supreme Court. One study was conducted by the Washington Post, the other by Tribune Co., which owns the Chicago Tribune, the Orlando Sentinel, and the Fort Lauderdale Sun-Sentinel. The Post endorsed Gore editorially in the November election, while the Tribune endorsed Bush. The Post reviewed computerized records of 2.7 million votes in eight of Florida's largest counties to examine the pattern of the so-called overvotes, those ballots on which computer scanners or other vote-counting machines detected votes for more than one presidential candidate and discarded the ballots as invalid. The newspaper did not recount individual ballots, but relied on reports from county officials based on machine tabulation of the invalid ballots. The analysis found that of the more than 60,000 ballots in the eight counties showing overvotesthe bulk of the statewide totalGore's name was marked on 46,000, while Bush was marked on only 17,000. This includes several thousand ballots in which both Gore and Bush were marked. The 3-1 Democratic to Republican ratio among the overvotes was confirmed in the analysis of other votes cast by those voters further down the ballot. Three quarters of those who improperly cast a presidential overvote marked their ballots correctly for US senator. Of these, 70 percent voted for Democrat Bill Nelson, only 24 percent for Republican Bill McCollum, while 6 percent voted for third-party candidates. The nearly 30,000-vote margin for Gore among the overvotes dwarfs the 537 votes which was Bush's official margin of victory in Florida. On the basis of that minuscule and highly dubious number, the Republican- controlled state government, headed by his brother, Governor Jeb Bush, awarded him the state's 25 electoral votes and a four-vote margin in the Electoral College nationally. The eight counties examined by the Post included Miami-Dade, Palm Beach, Broward (Fort Lauderdale), Pinellas (St. Petersburg), Hillsborough (Tampa), Marion (Ocala), Highlands and Pasco. Four of these counties went for Gore and four for Bush. The pattern of more overvotes for Gore prevailed in all the counties, however, regardless of who won the county overall. The notorious butterfly ballot in Palm Beach County accounted for 8,000 of the Gore overvotes, most of them double votes for Gore and far-right Reform Party candidate Patrick Buchanan, who was listed across from Gore on the ballot, with his punch-hole close to the names of Gore and Lieberman. Gore-Buchanan voters in Palm Beach County voted 10-1 Democratic in the US Senate race. In the other seven counties, the largest group of overvotes were for Gore and the candidate who followed immediately after him on the ballot, Libertarian Harry Browne. Such a combination is incomprehensible as a protest vote, especially one supposedly chosen by 6,800 voters. It more likely reflects confusion among voters who thought they had to cast votes for president and vice-president. Confirming the notion that the overvotes were largely intended for Gore is the fact that most of the third-party candidates on the ballot for president received more votes paired with Gore as overvotes than they did in their own right. In the eight counties, Socialist Workers Party candidate James Harris received a total of 300 votes, but his name was punched 12,600 times on ballots with Gore, Bush or another presidential candidate42 inadvertent votes for each intentional vote. The Republican head of the Florida Division of Elections, Clay Roberts, dismissed the Post analysis with an argument of stupefying cynicism, claiming that overvotes were intentional political choices. People who are engaged in politics can't understand why people would overvote, he said. But there are valid reasons for undervotes and overvotes. For some voters, that undervote or overvote is their decision. The Post also found more than 15,000 voters in the eight counties who cast no recorded votes for any office or referendum. So far, the Clinton's have been responsive to recent criticism: they are going to pay half for the gifts taken, and half for the rent of Bill's office. But the damage has already been done - they are made to appear as greedy grasping trailer trash. I am almost forced to like and admire them in spite of the faults of the administration simply because they are so relentlessly harangued. Samantha Let's face it, endless haranging is the Clinton's lot. It keeps people from watching what the Republicans are getting away with. Now we come to a new idea. Can anyone give anything they want to give to the White House? If you designate that gift as to the White House, are they forced to keep it in there forever? I have a couple of items I'd like to donate. What happens if the new first lady can't stand an item? Does she have to use it anyway? This could be wonderful. They would have been fairly old hat by the time the Reagans left to go to the ranch (presented to them by an admirer). Thank God no one gave Clinton a ranch. Sensational details about Rich's ultimate high-wire act as a spy for Israel and other countries were provided to The Post as congressional committees prepare to hold hearings into former President Bill Clinton's controversial decision to pardon the fugitive commodities trader. Among the issues that will be explored by the House Oversight Committee in its probe of the hotly disputed Rich pardon, according to congressional sources, are: * Rich's lengthy relationship with the Israeli Mossad. * His numerous contacts with federal prosecutors in New York, during which his lawyers offered to provide intelligence to the CIA in return for leniency. A CIA spokesman denied any relationship with Rich and said no one from the agency participated in behind-the-scenes White House discussions about his pardon. But Israeli Prime Minister Ehud Barak repeatedly cited Rich's contributions to Israel's "national security" in phone calls to President Clinton last month in which he lobbied for Rich's pardon, according to Barak spokesman Gadi Baltiansky. And a letter from former Mossad chief Shabtai Shavit to Clinton confirming that Rich provided "assistance" to the Israeli spy agency that produced results "beyond the expected" was among the documents released last week by Rich's lawyer Jack Quinn to support the Rich pardon. "The government of Israel considered Rich a critical ally, and the president took that seriously when he considered the pardon request," former White House spokesman Jake Siewert told The Post. Rich and partner Pincus Green fled the country in 1983 ahead of federal charges that they ripped off taxpayers for $48 million. Both were among the 140 people pardoned or given clemency on Clinton's last day in office. A storm of controversy has erupted over the unusual way the Rich pardon was handled, as well as over the involvement of Rich's ex-wife, Denise Rich, who raised $1 million for the Democratic party and gave the Clintons $7,000 in furniture for their new homes. Accounts of Rich's life on the lam - provided by former prosecutors, Rich's lawyers and the Israeli government - sound like a plot from a James Bond movie as the ruthless and nimble Rich extended his empire on five continents and built up a business worth almost $30 billion. He sold Iranian oil to Israel and Nigerian oil to South Africa. He brokered the sale of North Korean arms to Iran and did several deals involving gold, grain, nickel and tin with the Russian Mafia and henchmen of the former Soviet Union. And it's now clear that Rich also dealt in the most valuable commodity of all - information. He used what one of his former lawyers called a "mammoth information-gathering operation" to gain entree to governments and to support his businesses. "He was one of the biggest commodities traders in the world and had offices and active operations in all sorts of countries. He had friends in all sorts of places - high and low - and he certainly was in a position to provide sensitive information from a number of places," said Martin Auerbach, one of two former assistant U.S. attorneys who prosecuted Rich and tracked him throughout the years. Lawyers close to the case say there is no doubt that Rich had contacts with spies and security services throughout Europe and the Middle East. Those contacts not only helped him make money but may have also helped him stay one step ahead of U.S. lawmen trying to capture him, lawyers say. Former New York Police Commissioner Howard Safir said he tried several times to trap Rich and bring him back to the United States, when he headed the U.S. Marshals Service, but Rich constantly eluded the federal dragnet. Shavit, who headed the Mossad from 1989 to 1996, provided a fascinating glimpse of Rich's role in the murky netherworld of spies. In his letter to Clinton released by Quinn's office, Shavit said that he had a long relationship with Rich. "We requested his assistance in looking for MIAs and his help in the rescue and evacuation of Jews from enemy countries," Shavit wrote. "Mr. Rich always agreed and used his extensive network of contacts in these countries to produce results that sometimes were beyond the expected." Murkier still were Rich's efforts to become a superspy for the CIA. During his intrigue-filled exile, Rich's lawyers made numerous approaches to government prosecutors, offering intelligence to the CIA about the terrorists and rogue governments he dealt with in return for being allowed to return to the United States without being subjected to a jail sentence, Auerbach said. Pavel Borodin, a close ally of Russian President Vladimir Putin, was arrested at John F. Kennedy airport in New York on Jan. 17 on a Swiss warrant. He was traveling to the U.S. to attend a George W. Bush presidential inauguration dinner at the invitation of V. James Zenga, an American fund-raiser for the Bush campaign whose telecommunications company has business in Russia. Immediately after the arrest, Mr. Zenga said Mr. Borodin had received the dinner invitation "inadvertently," and denied knowing Mr. Borodin or having any business dealings with the Russian government. Clarifying the matter in a written statement to The Wall Street Journal, Mr. Zenga said he had invited Mr. Borodin and two other Russian officials "to come to the United States for exploratory business meetings concerning government projects." But he repeated that he had never met Mr. Borodin and that his company, StarCapital, hadn't intended to invite Mr. Borodin to the inauguration dinner. Mr. Zenga did meet with Mr. Borodin's associates after the arrest to discuss "various telecommunications and infrastructure projects" in Russia. One topic of discussion, Mr. Zenga said, was a road that Mr. Borodin wants to build from Berlin to Moscow that would be lined by fiber-optic cables. Days before flying to New York, Mr. Borodin told a news conference in Moscow that the road project would create "the most pleasant opportunities for [foreign] investment." A spokesman for Mr. Borodin said two Russian officials who accompanied Mr. Borodin to the U.S. met with Mr. Zenga in Washington to discuss the road project on Jan. 21. Swiss prosecutors are seeking to question Mr. Borodin about allegations that offshore bank accounts he or his family control received kickbacks totaling more than $25 million (26.7 million euros) from Swiss-based companies that renovated the Kremlin. The Swiss issued the arrest warrant in January 2000. Russian prosecutors closed their probe into the case in December, saying there was no evidence of a crime. Mr. Borodin, who was property manager for Boris Yeltsin's Kremlin and now heads an effort to reunite Belarus and Russia, has in the past denied any wrongdoing and said he has no bank accounts abroad. He is currently in a New York jail waiting for a federal court to decide whether to extradite him to Switzerland. Mr. Clinton hoped to secure his environmental legacy by effectively prohibiting natural resources development on 58 million acres of public land. However, White House Chief of Staff Andrew Card issued a Jan. 20 memo to all agencies requesting that new rules and regulations be blocked to "ensure that the president's appointees have the opportunity to review any new or pending regulations." The action was published yesterday in the Federal Register , making it official and delaying implementation of the contentious rule from March 13 to May 12. The delay is "necessary to give department officials the opportunity for further review and consideration of new regulations consistent with the . . . memo," said Kevin Herglotz, spokesman for the Agriculture Department. Mr. Herglotz would not speculate on what, if any, changes would be made to alter the regulations, which he described as hundreds of pages of complex technical documents. "This regulation is in the review process; no decision has been made at this time," Mr. Herglotz said. House and Senate Republicans were critical of the Clinton administration for bypassing Congress and restricting land use through the federal regulatory process. Republican leaders had urged Mr. Bush to overturn or delay the rule. Hundreds of public meetings were held throughout the country on Mr. Clinton's forest plan, and the U.S. Forest Service received 130,000 public comments on the issue. Environmentalists supported the ban, but opponents, mostly Westerners, said it would endanger forest health through uncontrolled insect infestation. Lawmakers said new roads are needed to gain access to the woods to fight forest fires. Last year, 92,000 wildfires swept across 7.3 million acres. Republicans also said public input was ignored. Daniels, OMB director. "Although we understand the desire of the incoming administration to review new and pending regulations, we are concerned that the Card memorandum could be used to undermine long-needed safeguards," the letter said. Meanwhile, the Senate Energy and Natural Resources Committee plans to hold hearings to review the process and determine whether the regulations can be overturned by Congress, said a committee spokesman. House Resources Committee Chairman James V. Hansen said his committee also will "vigorously" review the regulations. -Caveat Lector- We Know What Juno Juno, one of three remaining free Internet service providers, already requires subscribers to view ads and share market data, but they've come up with a scheme to raise more revenue by selling your untapped computing power to researchers and corporations. The idea is controversial for a lot of reasons, not the least of which is requiring subscribers to leave their computers turned on and logged in at all times. The software would work much like the SETI@home screen saver, which millions of users have installed and which crunches SETI numbers when your PC is idle. Juno's "agreement" goes much further, though, and it involves a measure of control of your computer. Privacy advocates are concerned, to say the least. Glenn Braswell made the list. Presidential forgiveness covered Braswell's 1983 convictions for fraud, perjury and tax evasion, restoring his civil rights. Yet, even as Clinton was granting Braswell a pardon, federal investigators were examining what they called "a massive tax evasion and money-laundering scheme" allegedly conducted by Braswell and his California dietary supplement empire. No charges have been filed in the investigation of what a prosecutor in California court documents describes as an effort by Braswell to move millions of dollars offshore through a shell company. It is not clear whether Clinton was aware of the current criminal investigation. The former president has not discussed the case, and efforts to reach him for comment through spokesman Jake Siewert were unsuccessful. Justice Department officials would not discuss Braswell's pardon. Amid the flurry of last-minute pardons and commutations, Braswell's name was one of about two dozen announced without details, suggesting that Clinton had left little time for federal law officers to evaluate Braswell. Yet, less than four months before his pardon, Braswell invoked the Fifth Amendment against self-incrimination more than 100 times in a two-hour deposition in a South Carolina civil case, opposing lawyer Vernon Glenn said yesterday. After the pardon was announced Jan. 20, federal investigators worried that Clinton had pardoned Braswell for any criminal charges that could arise from the current investigation. Assured yesterday by the Justice Department that the pardon covered only the 1983 case, Los Angeles prosecutors said they will continue to pursue the money-laundering and tax matters. Former Miami U.S. attorney Kendall Coffey, one of former vice president Al Gore's attorneys in the Florida recount case, represented Braswell in his effort to obtain a pardon. Coffey did not return several telephone calls seeking comment. Washington attorney Gerald Feffer, who represents Braswell in the tax and money-laundering probe, declined to discuss his client. Braswell "has probably managed to sell more health-related products with misleading claims than anyone else in the history of the world. In the 16 days since the pardons were announced, Clinton has been excoriated for his decisions and the last-minute confusion of the process. In a number of cases, he issued pardons or commutations without conducting traditional consultations with the Justice Department. The pardon of fugitive commodities trader Marc Rich, who renounced his U.S. citizenship to avoid extradition and trial, has triggered two Capitol Hill inquiries. Braswell's companies, including Gero Vita International, sell herbs and vitamins, and market them through mass mailings and a company magazine, the Journal of Longevity. Advertisements proclaim the ability to slow the aging process, cure hereditary baldness, shrink prostate glands and enlarge breasts, among other achievements. Among the doubters are the Food and Drug Administration and the Federal Trade Commission, which have issued notices critical of the companies. In 1995, the FDA banned the importation of Gero Vita products sold on the basis of claims that they can prevent or treat disease. The editors of Consumer Reports wrote in 1998: "We see a lot of misleading marketing, but what spews out of Gero Vita Industries rivals the worst." They said the company sent glossy booklets "masquerading as science. The booklets cite actual studies, but twist the findings to support the company's own unsubstantiated claims." "One of the company's most highly hyped products is GH3, a vitamin and herb medley that costs $29.95 a month," the magazine continued. "The promotional material calls it an anti-aging formula. The FDA calls it 'an old health-fraud product.' " IRS agents raided Braswell's business in Marina Del Rey, Calif., in 1999. In a document filed six months later in an unrelated Santa Monica civil suit, Assistant U.S. Attorney Paul H. Rochmes accused Braswell of conducting a "massive" scheme to ship money beyond the reach of U.S. tax authorities. Bull. By the time the Industrial Revolution took hold in the northeast -- and this was in the century BEFORE the Civil War -- slavery was already being legislated out of existence in those states. The industrialized north had no need of slaves, or even ex-slaves, as there were more than enough bodies immigrating from overseas to work cheaply in the mills and factories... You spend the time researching the ethnic makeup of those who worked in the northern mills and factories at the time, and you will find that almost none of them employed blacks...first it was Irish and German, later it was Italian, Portuguese, and Russian and eastern European... That situation lasted until well into the 20th century...blacks didn't start getting employed in any numbers in factories until the early 20th century, and then for the most part only in Detroit and Chicago... If you criticize Israel's brutal treatment of the Palestinians, you will be called an anti-Semite. If you defend the Boy Scouts' right to exclude homosexuals, you will be called a homophobe. If you defend the right of unborn children to live, you will be called a sexist. If you are a Christian with firm convictions about your faith, you will be called an extremist. All of these are examples of what logicians call argumentum ad hominem. Instead of dealing with the issue that was raised, you simply attack the person who raised it. It has become common in this age of special-interest groups and bitter partisanship. You should be concerned. I say you because I am a genetic contrarian and will continue to say what I think without regard for who purports to be offended by it. I am contemptuous of name-callers but otherwise pay them no attention. I am also contemptuous of people easily intimidated by special-interest groups. Every American should pause and think of the brave people in other countries unafraid to speak the truth not just to power but to cruelty, murder and torture. How can any American shrink from a mere verbal confrontation? The American model of self-government devised by the Founding Fathers is a whole concept. If parts of it are destroyed, the whole of it is destroyed. Freedom of speech and assembly are guaranteed because they are absolutely necessary for self-government. If you are denied information or if certain subjects are declared to be off-limits for debate, then you will no longer be able to participate in self-government. Your freedom will have been stolen. You will be governed all right, but not by yourself and a majority of your fellow citizens. There should be no topic -- and I mean no topic -- that Americans cannot discuss and debate publicly and in full without being subjected to attempted intimidation by character assassination. If there is one thing that should be totally absent from American life, it is fear on the part of an honest citizen to exercise his rights. The only way to achieve that is for all citizens to make a firm commitment to defend freedom of speech. Freedom of speech, by the way, is really freedom of thought. There is no right of any government or group to dictate what a person thinks. In truth there is no reason why any topic, however contentious, cannot be discussed in a civil manner, except for the malice of certain groups. Whenever people reveal themselves to be uninterested in discussion, they should be shunned by civilized people. They are following the totalitarian model in which one's opponents are not bested in arguments but shouted down, intimidated and, in the end, coerced into silence. Unfortunately, television is the demagogue's medium. Television hosts like the drama of insults and loud voices. Here again, Americans should shun such shows and complain to the employers and advertisers. Americans frankly have not been that good at defending their basic rights, simply because they have been unwilling to defend those rights when they are being exercised by someone with whom they disagree. That is a fatal attitude. Unless everyone is free to speak, everyone else's freedom is in jeopardy. We don't have to agree, but we do have to learn to disagree without going to war. -Caveat Lector- June, I suggest you read the following historical document taken from the archives of your own state. Note none of the 7-12 years as you stated and and the slaves were "without wage." This is the exact opposite of your claim. Of course I am not talking about the legislation leading to the actual outbreak of war but going back a bit to the way things were in northern states from the last of the 1600 until around 1800. Your description bears no resemblance to the truth of the matter. This petition, which the governor did not even bother to present to the legislature states that the slaves in Connecticut were born in this country in slavery and died in slavery without wages. This is the guilt which you attempt to project onto the south alone as though these things did not happen in the north but they most certainly did. I suggest you get yourself a history book as you are full of false information and revisionist claims. You often stat the you are all for truth but you post fabrications. Of course later situations changed because otherwise the north would have been fighting itself. And counting conditions in territories at the outbreak of war has nothing to do with the fact that slavery existed in the states that were states prior to al the legislation and conflicts beginning. The document is posted below which tells the truth of this "benevolent" northern slavery which you fabricate. Click here to go to the Black History theme site. JDR In the days when slavery was common in New England, Portsmouth had a large proportion of the slaves held in the State. There were in this town, in 1767, one hundred and twenty-four male and sixty-three female slaves. Their masters were generally kind to them, and they were permitted not only to enjoy their own social meetings, but were aided in sustaining a mock government among themselves. There were Negroes of distinction then, and there was nearly as much ebony as topaz gloss on the face of society. Among the top of the Negro quality in former times, was Cyrus Bruce, for many years the waiter on Gov. Langdon. There could scarcely be found in Portsmouth, not excepting the Governor himself, one who dressed more elegantly or exhibited a more gentlemanly appearance. His heavy gold chain and seals, his fine black or blue broadcloth coat and small clothes, his silk stockings and silver-buckled shoes, his ruffles and carefully plaited linen, are well remembered by many of the present generation. Some of the blacks were good mechanics. The parlor of the house of the late Richard Hart, on Russell street, was handsomely finished by Caesar, a house slave. Prime Fowle was the pressman of the first paper printed in New Hampshire. Through long service in bending over the press, he was bent to an angle of about forty-five degrees. He mourned the loss of his mistress and called her an old fool for dying. At funerals, it was the custom for the Negroes of the family to walk at the left hand of each white survivor, among the chief mourners. At the funeral of Mrs. Fowle, Prime should have gone on the left of his master, but he went on the right. His master whispered, "Go the other side." Prime did not move. His master touched him and whispered again, "Go the other side." This was too much. The old peppery Negro sputtered out, as loud as he could, "Go tudder side ye sef, y e mean jade." Cuffee Chase, brother of Dinah Whipple, was of a resentful spirit, and could not easily forgive an injury. His master's horse bit him one day, and Cuffee in return deprived him for several days of his food, and had almost starved the animal before the family discovered the cause of his failure. The slave of Rev. Joseph Stevens, of Kittery, had a better apology for a similar act. His master, as he saw him picking some bones for dinner which had been already well trimmed, said to him, "Nearer the bone the sweeter the meat, Sambo." Not long after, he was sent to the pasture with the horse of a visiting clergyman, which he tied to a pile of rocks. To a reproof for the act, Sambo replied, " Nearer the bone, the sweeter the meat - nearer the rock, the sweeter the grass, massa." Jonathan Warner had several slaves, among them Peter. One day Peter's hat being the worse for wear, he asked his master for a better covering for his head. "If you will make a rhyme, Peter, you shall have a new hat," said his master. This was discouraging to Peter, for he was never guilty of such a thing in his life. He left in a very thoughtful mood, and at length resolved to get assistance in his difficulty. He goes to the office of Wyseman Claggett, and states his case, "What is your name? " asked the counselor. "Peter Warner, massa." "Peter Warner - threw his hat in the chimney corner," said Mr. C. playfully. "There is your rhyme, now go and get your new hat." Peter went home, repeating the rhyme all the way, and hastened to the parlor. "Massa, I've got the rhyme." said he, much elated. "Well, say it." "Peter Warner - took off his hat and threw it - in the fireplace." Peter received his hat, his master remarking that it was nearer to a rhyme than he expected of him. Some slaves had intellect somewhat inferior to Peter's. Dinah, a slave in the family of Samuel Ham, on Freeman's point, could not count five. Yugoslav troops were on the ground, breathing air spiked with DU particles, while NATO personnel played joystick war from bombers flying safely above the clouds. Leukemia is a disease of the blood-forming organs. "Its cause is unknown but it is considered to be of the same nature as that of various other forms of cancer [...] Probably many factors lead to its development. One that is clearly established is exposure to irradiation," states a 1960 encyclopedia, while one from 1996 added half a dozen causes. There is no doubt that the disease is a form of cancer: "An almost uniformly fatal cancerous disease characterized by excessive production of white blood cells," according to the Random House dictionary. NATO and the media first emphasized "leukemia" cases from the Balkans. This was as significant as invoking miscellaneous chemical and social factors as possible causes of soldiers' deaths and illnesses from DU. The military did not examine all cases and also hid evidence, so it's likely leukemia was not the main cause of death. Most probably, the mounting evidence of non-leukemic cases made NATO switch abruptly on January 24th, 2001, from the broken record of "no link between DU and leukemia" to "no link between DU and any forms of cancer." This was the first indirect indication by NATO that not just "leukemia" cases may be involved and that NATO was preparing a disinformation campaign against that incriminating fact. The analogy with car risks does not arouse comparable concern from medical scientists, doctors and health policy bureaucrats on NATO's payroll. On DU, it seems, mainly an army of NATO propagandists and a handful of true scientists have spoken out in an information war between government lies and the medical and scientific truth. Since many factors besides DU could cause leukemia, it became an opportune "theme" to fool the public with. NATO will not admit that they spread most of the other "factors" in the course of recent wars. Whether from DU or from other pollution, veterans from NATO's toxic- nuclear wars, and civilians living downwind from affected battlefields, are getting sick and dying. Which of the 'leukemia' cases come from Kosovo, and which ones date to the 1994-95 Bosnia war? Also foggy are figures on total military casualties attributable to the Balkan Syndrome. NATO should not and can not be trusted to provide reliable figures. Would anyone sane entrust, for example, the tobacco industry to conduct investigations of lung cancer causation? Lack of published data on the Balkan Syndrome among Bosnia- Herzegovina and Kosovo civilians is an outright scandal, for which the UN and NATO administrations are as responsible as their local counterparts. The Balkan Syndrome, investigated under such auspices, would be managed like the Gulf War Syndrome was earlier: denial, blaming "other factors", manipulation of reports, criminal neglect of sick veterans, wrong medical examination procedures, hiding medical records, and indifference to the fate of local populations. A direct attack against American citizens on American soil is likely over the next quarter century. In the face of this threat, our nation has no coherent or integrated governmental structures. We therefore recommend the creation of a new independent National Homeland Security Agency (NHSA) with responsibility, for planning, coordinating, and integrating various U.S. government activities involved in homeland security. NHSA would be built upon the Federal Emergency Management Agency, with the three organizations currently on the front line of border security -- the Coast Guard, the Customs Service, and the Border Patrol -- transferred to it. NHSA would not only protect American lives, but also assume responsibility for overseeing the protection of the nation's critical infrastructure, including information technology. The NHSA Director would have Cabinet status and would be a statutory advisor to the National Security Council. The legal foundation for the National Homeland Security Agency would rest firmly within the array of Constitutional guarantees for civil liberties. The observance of these guarantees in the event of a national security emergency would be safeguarded by NHSA's interagency coordinating activities-which would include the Department of Justice-as we] I as by its conduct of advance exercises. The potentially catastrophic nature of homeland attacks necessitates our being prepared to use the tremendous resources of the Department of Defense (DoD). Therefore, the department needs to pay far more attention to this mission in the future. We recommend that a new office of Assistant Secretary, for Homeland Security be created to oversee the various DoD activities and ensure that the necessary resources are made available. New priorities also need to be set for the U.S. armed forces in light of the threat to the homeland. We urge, in particular, that the National Guard be given homeland security as a primary mission, as the U.S. Constitution itself ordains. The National Guard should be reorganized, trained, and equipped to undertake that mission. Finally, we recommend that Congress reorganize itself to accommodate this Executive Branch realignment, and that it also, form a special select committee, for homeland security to provide Congressional support and oversight in this critical area. By William Blum The newspapers were filled with pictures of happy relatives of the victims of the 1988 bombing of PanAm 103. A Libyan, Abdelbaset Ali Mohmed al Megrahi, was found guilty of the bombing by a Scottish court in the Hague, his co-defendant, Al Amin Khalifa Fhimah, being acquitted. At long last there was going to be some kind of closure for the families. So what's wrong with this picture? What's wrong is that the evidence against Megrahi was stretched thin to the point of transparency. Indeed, the court verdict might be dubbed Supreme Court II, another instance of non-judicial factors clouding judicial reasoning. The three Scottish judges cannot have relished returning to the United Kingdom after finding both defendants innocent of the murder of 270 people, largely from the U.K. and the United States. Not to mention having to face dozens of hysterical victims' family members in the courtroom. As with any horrendous crime, there's a desire for someone to be punished. That's an especially strong sentiment when a defendant is from an unpopular racial or ethnic group, in this case, a Libyan. The three judges also knew the desires of the White House and Downing Street as to the outcome. One has to read the entire 26,000-word Opinion of the Court which accompanied the verdict, as well as being very familiar with the history of the case going back to 1988, to appreciate what the judges did. The Case The key charge against Megrahi -- the sine qua non -- is that he caused a suitcase with explosives to be loaded at Malta airport and tagged it so it would pass through Malta, Frankfurt and London airports without an accompanying passenger and without being detected. That by itself would have been a major feat and so unlikely to happen that any terrorist with any common sense would have found a better way. But aside from anything else, we have this -- as to the first step, loading the suitcase at Malta: there is no witness, no video, no document, no fingerprints, no forensic evidence of any kind linking Megrahi -- or anyone else -- to such an act. And the court admits it: "The absence of any explanation of the method by which the primary suitcase might have been placed on board KM180 [Air Malta] is a major difficulty for the Crown case." The case for the suitcase's hypothetical travels must also deal with the fact that, according to Air Malta, all the documented luggage on KM180 was collected by passengers in Frankfurt and did not continue in transit to London, and that two PanAm on-duty officials in Frankfurt testified that no unaccompanied luggage was introduced onto PanAm 103A, the feeder flight to London. Moreover, under security requirements in 1988, unaccompanied baggage was subjected to special x-ray examinations, plus -- because of a recent event -- the security personnel were on the lookout specifically for a bomb secreted in a radio, as was the case with the PanAm 103 bomb. To counter this evidence, the judges cite some sketchy and confusing notations about the movement of luggage wagons within the Frankfurt airport. The prosecution introduced these records to suggest that some unidentified luggage still might have gone from KM180 to a baggage clearinghouse at the airport and theoretically could have gone from there to PanAm 103A. But the prosecution never called the official who made the key notations and was responsible for processing the baggage to explain what the sketchy records might mean. Nevertheless, the judges seized on these notations to conclude that "the documentary evidence as a whole therefore clearly gives rise to the inference that an item which came in on KM180 was transferred to and left on PA103A." Heathrow Security The prosecution's case encountered more complexities at Heathrow Airport outside London. Again there was no evidence that luggage originating from Malta was loaded onto PanAm 103. The trial evidence also revealed that Heathrow had lax security around the "baggage build-up area" where luggage for PanAm 103 was stored prior to the flight. "The build-up area was adjacent to a roadway extensively used by persons within the airport," the judges said. "In December 1988, it was busier than usual because construction work was in progress at the airport." The bin for the luggage was marked PanAm 103, according to testimony, so it was not a mystery where suitcases in the bin were headed. "There was no security guard outside the shed, so that the placing of items on the conveyor belt was unsupervised," stated the court opinion. After loading suitcases into the bin, one of the baggage handlers testified that he left the area to have a cup of tea. "On his return, he saw that two cases had been added to the container," including one "brown or maroony-brown hardshell Samsonite-type case," which matched the description of

PAUL KAIL ACTIVISM | 01.17.01 BSE (Bovine Spongiform Encephalopathy), or Mad Cow Disease, and its human form, nvCJD (New Variant Creutzfeldt-Jacob Disease), are incurable brain disorders. Holes appear in victims' brains, then they become demented and die. The diseases are not caused by a virus or a bacterium, but by a mysterious type of twisted protein, known as a "prion". The prion can propagate itself by causing other proteins to twist into the same shape. Prions can be passed on by eating the flesh of another animal, and are resistant to cooking and digestion. A theory about how prions are formed suggests that organophosphate pesticides could be partly to blame. Two people have already died defending this theory, apparently at the hands of professional assassins working either for the British government or the chemical industry. So the theory needs to be taken seriously. BSE first appeared in the UK in 1985. Since then, the disease has affected half of the cow herds in the country. New Variant CJD also first appeared in the UK, ten years later: to date, around 90 people have died from it. Both BSE and CDJ are beginning to spread throughout the rest of Europe; today, 30 European countries have had exports of their cattle banned. The diseases have the potential to destroy the entire European cattle industry, and kill thousands of people. The death toll from nvCJD is increasing by 35% per year, and the disease has a gestation period of twenty years. Some projections suggest that hundreds of thousands of people could eventually die from it. Given the huge amount at stake, one might expect that any credible theory would be welcomed. Yet Mark Purdey, a British farmer from Somerset, has suffered constant harassment and has had to support his research from his own pocket. Purdey has a theory which might explain the mystery of why BSE and new variant nvCJD started in the UK, and why they are so much more serious there. However, since he went public with his ideas, some rather unfortunate things have happened: Both his vet and the lawyer defending his case died in suspicious road accidents. His second lawyer also had a car crash, but survived. When an article about his work appeared in the "Independent", a national British newspaper, his telephone lines were cut. He was therefore unable to take follow up calls from other papers and television stations. His farm house was burnt down just before he was about to move in. His science library was destroyed by a collapsing barn. When he travels around the country to talk about his theory, he is constantly trailed. Purdey believes that the root cause of BSE is an imbalance of magnesium and copper, exacerbated, in the case of the UK, by the use of a highly toxic pesticide known as phosmet. Phosphet is an organophosphate nerve toxin, originally developed by the Nazis. It is also related to the drug Thalidamide, which causes birth defects. Phosmet is made by Zeneca, a subdivision of the British chemical giant ICI. A week after the British government first announced the link between BSE and nvCJD, Zeneca sold the patent for phosmet to a PO Box company in Arizona, apparently to avoid potential legal action. The theory started when Purdey noticed that his cows, unlike those of his neighbours, were not getting BSE. Cows often suffer from a parasitic infection known as warble fly. Since Purdey is an organic farmer, he treated his herd with derris root powder, a natural remedy. Other farmers were using phosmet, which was later made compulsory throughout the UK. When Purdey bought an infected cow from another herd, he was able to reduce the symptoms of BSE by injecting oxime, which is an antidote to pesticide poisoning. However, officials from MAFF (the Ministry for Agriculture, Fisheries and Food) turned up to kill the cow before the experiment could be completed. As well as the link to phosmet use, Purdey discovered that brain diseases such as BSE and nvCJD appear in clusters in many places around the world. The link seems to be a lack of copper and an excess of manganese. For example, in some areas of Colorado and Wyoming, 4-6% of deer and elk suffer from CWD (Chronic Wasting Disease), which is related to nvCJD. These animals live in areas where the soils are very high in manganese. In Slovakia, where the incidence of nvCJD is a thousand times higher than normal, most of the victims live near a glass making plant (where manganese is used) or else down-wind of one of two large ferro-manganese factories. In the UK, two factors have increased the amount of manganese which cows consume. Until 1988, cows were fed chicken manure. The chicken had been fed manganese to strengthen their eggs, but 98% of it ended up in the manure. In addition, a fungicide rich in manganese was used on crops at that time. You've got to be kidding How does President Bush expect to "raise the tone" in Washington by nominating a right-wing celebrity and Kenneth Starr pal as solicitor general? - - - - - - - - - - - - By Joe Conason Feb. 6, 2001 | Controversy rarely accompanies the appointment of a new solicitor general, the powerful Justice Department official who represents the United States government before the Supreme Court. But an angry confirmation debate could ensue this month if President Bush names the man whose name was leaked by the White House last week: Theodore B. Olson. On paper, Olson's qualifications to serve as solicitor general are beyond reproach. He is widely acknowledged to be one of the nation's most experienced and capable appellate litigators, and he possesses more than a dozen of the white quill pens that are given to lawyers when they argue before the high court. His most recent appearance there occurred in December, when he represented the Bush-Cheney campaign in the Florida election case that divided the court and the nation so bitterly. Aside from the five Supreme Court justices who voted in his favor, there may be no one to whom Bush owes his victory more than Olson. There is another, darker side to the 59-year-old Republican attorney, however, which may trouble the Democratic senators who would have to decide whether Olson should be confirmed. Over the past several years, this partisan legal warrior has sought the ruin of the Clinton administration and the personal destruction of the former first family by any means necessary. He was a central figure in the shadowy "Arkansas Project," which funneled more than $2 million through the tax-exempt American Spectator magazine to private investigators digging up anti-Clinton dirt. He wrote anonymous articles for the Spectator that suggested that various Clinton administration officials were guilty of felonies, and compared the White House to a Mafia crime family. And he secretly coached the lawyers for Paula Jones before their own appearance at the Supreme Court. Indeed, considering Olson's furious obsession with the Clintons and his dubious conduct in pursuing them, his appointment would cast grave doubt on the new president's vow to "raise the tone" of public life in the capital. Olson's career as a conservative lawyer is full of ironies. His long association with the Republican right dates back to the 1970s, when he worked in the Los Angeles offices of Gibson, Dunn Crutcher with William French Smith, later the first attorney general in the Reagan administration, and Kenneth Starr, who joined the Reagan Justice Department along with Olson and Smith. Among Olson's clients then was Ronald Reagan, whom he continued to represent as a private attorney during the Iran-Contra investigation. Through the Bush and Clinton years, when Starr served as solicitor general himself and then as the Whitewater Independent Counsel, Olson has remained one of Starr's closest personal friends and political associates. Before he returned to private practice in 1985, Olson had an ill-fated sojourn as assistant attorney general. His actions and testimony during a congressional investigation of corruption at the Environmental Protection Agency led to the appointment of an independent counsel to investigate him. No criminal charges were brought against him, but the independent counsel's report strongly suggested that Olson had intentionally misled Congress even though his testimony had been "literally true." That four-year probe was financially and emotionally torturous for Olson, who fought all the way to the Supreme Court in an attempt to overturn the independent counsel statute on constitutional grounds. The court's historic decision against him in Morrison vs. Olson set the stage for his friend Starr's meandering six-year investigation of the Clintons and their associates a few years later. The acidulous partisanship that characterizes both Olson and his wife Barbara, an attorney who expresses their viewpoint in frequent appearances as a conservative television commentator, may derive from his ordeal in the EPA case, which he blamed on congressional Democrats who demanded an investigation of him. Since returning to private practice at the Washington offices of Gibson, Dunn, he has become not only a prominent appellate attorney but an eminence grise in the capital's conservative circles. Like his wife, he has served on the boards of various conservative foundations and think tanks, including the Washington Legal Foundation and the Independent Women's Forum, many of which are financed by Pittsburgh billionaire Richard Mellon Scaife. The Olsons' home in McLean, Va., is virtually a cocktail lounge for the likes of Starr, defeated Supreme Court nominee Robert Bork and other right-wing celebrities. Colin and Alma Powell are also in the photo, which was taken when the church officials went to the summit in Philadelphia, during the Clinton years, to promote Applied Scholastics. “The [Bush administration] initiative may break down the academic church/state formula and instead look at who can provide the help that’s really needed,” says a church spokesman. “I’m optimistic about the whole thing.” “The Bushes have long been associated with faith-based programs that address the needs of our society,” says cult and alternative religion expert Rick Ross, whose Web site, www.rickross.com, outlines the Bushes’ connections to the Rev. I suppose there may be. But not, surely, a poseur and windbag who receives (and takes as his due) such grotesque deference on moral questions. Look, if you will, at his essay on Jerusalem in the New York Times of January 24. As a Jew living in the United States, I have long denied myself the right to intervene in Israel's internal debates My critics have their conception of social and individual ethics; I have mine. But while I grant them their right to criticize, they sometimes deny mine to abstain. Such magnificent condescension, to grant his critics the right. And it is not certain from when Wiesel dates his high-minded abstention from Israel's internal affairs; he was a member of Menachem Begin's Irgun in the 1940s, when that force employed extreme violence against Arab civilians and was more than ready to use it against Jews. At all events, his dubious claim above is only a pompous preface to discarding nonintervention in the present because Jerusalem is at stake, and "the fact that I do not live in Jerusalem is secondary; Jerusalem lives within me." (Again the modesty.) There are, sad to say, serpents in Wiesel's internal Eden, and they too must be patronized: That Muslims might wish to maintain close ties with this city unlike any other is understandable. Although its name does not appear in the Koran, Jerusalem is the third holiest city in Islam. But for Jews, it remains the first. Not just the first; the only. "Might wish." "Ties." "Understandable." "Third holiest." Even these lordly and dismissive gestures clearly cost Wiesel something. After all, he announces that the city is "mentioned more than 600 times in the Bible," which (assuming for a moment that one ought to think like a religious fundamentalist in the first place) would give a Christian Arab--these being at least 15 percent of the Palestinian population--quite a strong claim on the old place. (Incidentally, let me ask any reader how often the city is mentioned in the Torah.) But for Wiesel all Arabs are Muslims, and even if they happen to live in Jerusalem, this is nothing to the way that Jerusalem dwells within Wiesel. Indeed, it would evidently dwell more comfortably within him if they did not live in it at all. Do I exaggerate? I don't think so. In a propaganda tour of recent history, he asserts that in 1948, "incited by their leaders, 600,000 Palestinians left the country convinced that, once Israel was vanquished, they would be able to return home." This claim is a cheap lie and is known by Wiesel to be a lie. It is furthermore an utterly discredited lie, and one that Israeli officialdom no longer cares to repeat. Israeli and Jewish historians have exposed it time and again: Every Arab broadcasting station in the region, in 1947 as well as 1948, was monitored and recorded and transcribed by the BBC, and every Arab newspaper has been scoured, and not one instance of such "incitement," in direct speech or reported speech, has ever come to light. The late historian and diplomat Erskine Childers issued an open challenge on the point as far back as the 1950s that was never taken up and never will be. And of course the lie is a Big Lie, because Expulsion-Denial lies at the root of the entire problem and helps poison the situation to this day. (When Israel's negotiators gingerly discuss the right of return, at least they don't claim to be arguing about ghosts, or Dead Souls.) In a brilliant reply to Wiesel published in Vesti, Israel's largest Russian-language paper, Israel Shamir compares him rather leniently not to Jabotinsky but to the Knight of the Doleful Countenance and his mad quest for purity: Be reasonable, old man. Stay within the frame of the story and within the bounds of common decency. Don Quixote did not drive his jeep into Toboso to rape his old flame. OK, you loved her, and thought about her, but it does not give you the right to kill her children, bulldoze her rose garden and put your boots on her dining-room table. Shamir speaks of the beautiful city that Palestinians centuries ago "adorned with a magnificent piece of jewelry, the Golden Dome of Haram al-Sharif, built their houses with pointed arches and wide porches, and planted cypresses and palm trees." He's wasting his time on Wiesel, who says that Palestine was a desert before he arrived there as one of Begin's thugs, and who slanders the people he helped dispossess, first by falsely saying that they ran away from their beloved ancestral hometown and second by disputing their right even to feel nostalgia for it. -Caveat Lector- The Orlando Sentinel ORLANDO, Fla. - An Orlando judge who to likes to educate himself about the issues he rules on is in trouble for asking too many questions outside his courtroom. A Florida state panel that monitors the conduct of judges says Circuit Judge Joe Baker of Orange County has committed ethical violations. The rules are clear: Judges are supposed to make decisions based solely information that lawyers provide during the case Baker calls that nonsense. He says lawyers working for clients are the last people to give him objective information. So when technical or scientific issues confuse him, he reads books and questions knowledgeable friends and relatives or experts around the country. Now he faces punishment ranging from a reprimand to removal from office if the panel - and eventually the Florida Supreme Court finds him guilty. "The lawyers are not interested in the judge having a full and complete and accurate understanding of the subject," Baker said. "They're interested in the judge seeing it their way." He said the court system should be interested in having judges make the most appropriate decision in a case. "Do you say a judge is bound and limited to what he or she sees in the courtroom?" "That's nonsense because it means the dumbest judge is the best. It exalts ignorance. It exalts subordination. It's saying judges should act dumb and stay dumb. But the Judicial Qualifications Commission maintains that Baker isn't giving lawyers a fair shake in his courtroom. It contends that lawyers trying a case have no idea what the judge learns from his outside conversations and should have an opportunity to rebut it. Not only that, Baker could receive inaccurate information and the lawyers won't know it, the commission says. At least if a judge reads a book and tells the lawyers about it, the attorneys have a chance to see what the judge has learned. JQC lawyer Charles Pillans, who is prosecuting Baker, would not comment on the case. But in legal papers, he says that contrary to Baker's arguments, rules of judicial conduct and legal precedent prohibit a judge from consulting with others. If judges are confused, they are supposed to ask lawyers to clear things up. To do that, lawyers can bring in expert witnesses on any subject. "His consultation with (outside) experts in this case clearly gives the appearance of impropriety, which, in light of Judge Baker's inability to appreciate the import of his conduct, must be addressed, " Pillans wrote. JQC officials maintain that the rules aren't meant to keep judges stupid. They can read what they want, draw on personal knowledge of a lifetime or even pursue degrees in such areas as medicine or engineering. According to the commission, general education is different from researching a specific issue in a case. Baker says he thinks the intent of the rules is to stop judges from discussing cases only with people involved in the case or with people who want to influence the judge's decision. Baker, 64, is one of Orlando's longest serving judges. Appointed to the bench in 1977, he has never faced opposition in an election. He is generally regarded as an intellect, an independent thinker and a bit eccentric. He is prone to quoting Socrates and other philosophers. A voracious reader and writer, Baker often questions some of the basic tenets of the court system. And his written rulings sometimes incorporate his thoughts about issues rather than sticking to the basic legal foundations. "I know how diligent he is and how hard he tries to do a good job," said Orlando lawyer Mayanne Downs, who is representing Baker. "Is the state of our judiciary such that this is what the JQC is pursuing? Is this a matter to sanction a public servant?" Downs said she thinks Baker could become the first judge in American history to be punished for educating himself. The case that got Baker in trouble involved computers. Universal Business Systems Inc. sued Disney Vacation Club Management Corp., over computer software it sold Disney for it's time-share business. Disney was supposed to return the software plus all the modifications made to it. That didn't happen. After a trial in 1999, a jury decided Disney should pay $2 million dollars in damages. But Baker later overturned its decision. He disagreed about how damages had been calculated. Instead he reduced the judgment to just $1000. An appeals court overturned Baker for several reasons, including that he talked about the case outside of the courtroom. In a memorandum, Baker wrote that he had spoken to several people about technical computer issues. He told the Orlando Sentinel that he talked to a friend who is a computer consultant and Baker's son-in-law. An engineer who is an expert on the computer systems of the U.S. Navy labs worldwide. Ballots By RACHEL LA CORTE, Associated Press Writer MIAMI (AP) - A research firm hired by several of the nation's largest news organizations began surveying thousands of presidential ballots Monday in an effort to create an independent record of the disputed Florida election. The National Opinion Research Center, a nonprofit firm affiliated with the University of Chicago, plans to build a database that will describe in detail the estimated 180,000 ballots that did not register a vote for president during machine counts. News organizations overseeing the review include The Associated Press, CNN, The New York Times, The Palm Beach Post, St. Petersburg Times, Tribune Publishing, The Wall Street Journal and The Washington Post. The project begins almost two months after the U.S. Supreme Court (news - web sites) stopped the ongoing recounts in Florida. George W. Bush (news - web sites) captured a razor-thin victory over Vice President Al Gore (news - web sites), carrying Florida by 537 votes out of 6 million cast, giving him the state's 25 electoral votes and thus the national election. ``This project was undertaken to provide an independent record of rejected ballots in the race that ultimately determined the 2000 presidential election,'' said Kevin Walsh, AP's chief of bureau for Florida. ``Our goal is to inspect and classify these ballots, and certainly not to challenge the certification of results.'' The review started Monday in five of Florida's 67 counties - Miami-Dade, Hillsborough, Pinellas, Polk and Pasco. The statewide review is expected to take at least eight weeks to complete. The research firm trained teams of workers to use the same standard in reviewing rejected ballots, including overvotes where voters indicated a preference for more than one candidate and undervotes where machines recorded no vote. For instance, in the 24 counties that use punchcard ballots, workers will simply describe distinguishing marks. That includes whether chads - the tiny perforated squares that voters punch out with a stylus to record their vote - are missing, hanging by one or more corners, or ``dimpled.'' Each worker is to make a determination and is not supposed to discuss the evaluation with other team members. The news organizations plan to use the database to produce their own stories. The data also will be released to the general public for additional research. Other Florida newspapers represented through their parent companies are The Orlando Sentinel, South Florida Sun-Sentinel based in Fort Lauderdale, Sarasota Herald-Tribune, Ocala Star-Banner, The (Lakeland) Ledger and The Gainesville Sun. Bin Laden, a dissident Saudi businessman, has been indicted for the 1998 bombing of two U.S. embassies in East Africa and has been named as a possible suspect behind last fall's bombing of the USS Cole destroyer in Yemen. Four alleged bin Laden associates went on trial Monday in federal court in New York for the embassy bombings. USA Today newspaper reported on Tuesday that bin Laden began using encryption five years ago, but recently increased its use after U.S. officials revealed they were tapping his satellite telephone calls from Afghanistan, where he lives. Busy Bulletin Boards Are Popular Target Venzke said just as the recipient reading a coded classified ad would know what to look for, a secret message could be embedded, or encrypted, in an image seen by millions on an Internet bulletin board. He cited the example of a pornographic picture labeled 'blond bombshell' posted on an Internet bulletin board which would probably be downloaded by thousands of users who were unaware of a coded message ``hidden'' in the existing image. ``The cell (guerrilla), though, will download that image, know what program to run to extract it, what encryption software to use to decrypt it and then will have that information,'' said Venzke, director of intelligence, special projects, at iDefense cyber-intelligence company in Virginia. Venzke declined to name sites where material is being hidden but said any bulletin board or public forum that generated lots of traffic was a target. ``Because it's done on a heavily-used public bulletin board, it's extremely challenging and difficult to track,'' he added. Security experts said some messages are scrambled using free encryption programs set up by groups that advocate privacy on the Internet, which are then decrypted using a code known only by the recipient and sender. Cia Worried About Use Of Internet One U.S. security official said the authorities were extremely worried about the use of the Internet by extremist groups and that this was an area being watched very closely. In testimony to Congress last year, the CIA (news - web sites)'s information operations issue manager, John Serabian, said Middle East groups such as Hizbollah, Hamas and bin Laden's, were using computerized files, email, and encryption to support their organizations. ``We also recognize that cyber tools offer them new, low-cost, easily hidden means to inflict damage. Terrorists and extremists already use the Internet to communicate, to raise funds, recruit, and gather intelligence,'' he said. CIA director George Tenet also addressed the issue in a closed hearing last year when he referred to millions of potential ``information warriors.'' GW Bush January 30, 2001 from his introduction to the agenda for his faith-based initiative, "Rally the Armies of Compassion." On the surface it sounds like a good idea. Let faith-based religious organizations compete with government programs for funds to service the homeless, the hungry, drug addicts, welfare recipients, children and prisoners. The notion of a Federally-funded "army" making war on social evils is not new. We've had the war against drugs and the war against poverty, programs which have consumed trillions of dollars in a failed attempt to eradicate poverty and drug use. Their main success? The creation of a huge Federal beauracracy. Making religious groups compete with government agencies for Federal funds also sounds good - until you really think about it. Since many of these groups use non-salaried volunteers or psychologically-coerced recruits as employees, they will have no trouble delivering services less expensively than a government program which provides relatively qualified employees with a salary and health benefits. As President of an artists' rights group which rejects funding and government interference of any kind I've observed the creativity and freedom of millions of American artists compromised through a similar system of competition for government money. Art and religion have much in common. You can make art without First Amendment freedom - Nazi Germany, the USSR and Communist China had vast art programs involving millions of exceptional artists. You can also have religion without religious freedom. All history will remember about such religious or artistic efforts is how spiritually dead they were. Millions of contemporary American artists now divide their time between applying for government grants and making art. Their ideas are conditioned by the grant requirements. Rather than helping America's artists, the NEA created a vast beauracracy of art lawyers, program administrators, curators and museum directors who serve as the gateway to government money. These administrators are the high priests of the art world. American museums, art galleries, television stations and theatrical companies must modify and self-censor their works every day thanks to this dependency on Federal funds. It's ironic to see the conservatives who led the fight against the NEA leading the fight to enslave religious institutions in this same money trap. Art and religion are the conscience of humankind, the voice which stands up to tyranny at great risk when all others have been silenced and compromised. America is a religious nation with thousands of sects and denominations that are substantially free of government control or regulation. Do we want our religious institutions to modify their messages as American artists have been forced to do? Do we want official religion the way we now have official art? It's worth noting how official art came about in the US. Most Americans have a dismissive attitude towards so-called modern art imagining that its abstract imagery is due to artistic preferences. In fact, it has far more to do with the CIA and America's ruling elite - in particular the Rockefeller family. [1] In the nineteen thirties and forties American artists were heavily involved in protests against poverty, racism and corporate control. They used figurative art, murals and realism not only to express their feeling about these social problems but to rally the public to do something about them. Then the State Department, the CIA and the Rockefellers stepped in and began promoting abstract art, beginning with the Rockefellers' Museum of Modern Art in NYC. Ever wonder why America's wealthiest families spend billions on giant paintings and sculptures that represent nothing and why the government erects huge museums to display these non-wonders? In the fifties and sixties the government created public school programs to brainwash American children about art. Millions of these children then grew up to become artists specializing in abstraction and non-figurative art. The CIA and these same ruling families are also behind President Bush's Army of Compassion which hopes to make religious organizations as dependent on government funding as arts institutions now are. Announced as a compassionate effort to promote charitable activity, the real intent is exactly the opposite - to control, compromise and co-opt it. The men Bush has put in charge of his faith-based initiative, John J. Dilulio Jr. and Stephen Goldsmith, are senior fellows of the CIA's Manhattan Institute, a right wing think tank co-funded by the Rockefellers' Chase Manhattan Bank, pharmaceutical companies and right wing foundations with ties to the military-industrial complex. Bush on Jan. 20. How could this massive media presence have failed to cover the huge anti-Bush protests all over Washington and in many other U.S. cities? Didn't they see the demonstrations? Was there confusion over what the protests were about? Was it a collective but benign error of omission? Or was it a highly coordinated effort between the corporate- dominated media and the government, including multiple police agencies, to spare the new administration the embarrassment of reporting the presence of tens of thousands of angry, often militant protesters who far outnumbered Bush's supporters along the parade route? On Jan. 21, the front pages of every major newspaper published in North America were filled with pictures and words glorifying and legitimizing Bush's foul ascendancy to the White House. Yet news of the mass protests was relegated to the back pages or, presumably, the editors' wastebaskets. Cable and broadcast TV networks like CNN, MSNBC, Fox and ABC carried live coverage of the inauguration. Each repeated the same bare minimum of information about protests, dismissing them as "not causing the security problems that were expected" or "loud but well contained." This type of reporting along the parade route was a pitiful substitute for any substantive commentary about the predominance of anti-Bush protesters clearly visible on camera and audible on tape. FLURRY OF MEDIA INTEREST BEFORE PROTESTS In the days and weeks before the inauguration, reporters constantly pursued protest organizers for information about demonstration plans. Many attended pre-inaugural news conferences held by organizers from the International Action Center and other groups and lawyers from the Partnership for Civil Justice. At these well-attended news conferences, organizers explained protest plans and disseminated information about the status of protest permits and the legality of security checkpoints. Some reporters asked permission to follow organizers around for periods of time to observe them in action in the days before Jan. 20. C-SPAN aired two of the news conferences in their entirety, and then repeated them. One result of the exposure was that organizers received an enormous response from the public. Another development that may have resulted from the exposure was a media pullback several days before the protests. Stories filed for the Washington Post and ABC World News Tonight, based on reporters' extensive interviews with IAC leaders, were mysteriously put on hold. This was done at the very time that a groundswell of organizing activity was building the protests. Rather than carrying the stories that more or less presented the protesters' point of view of the Post and ABC instead presented stories that hyped up the Secret Service's ostensible notions about the inauguration coming under missile attack, the need for unprecedented high-security measures, description of security checkpoints and so on. Imani Henry, an IAC organizer who staffed the mobilzation's offices in Washington, said he thought that "this was a relentless, targeted attempt to frighten Washington's large Black and Latina/o population away from the Saturday demonstrations, much as Bush forces tried to harass Black voters away from the polls in Florida. "The story about our protest was finally aired on World News Tonight the next evening, but the scare tactic was already out there in the community from the newspapers and TV the day before." 'WE'RE NOT COVERING THE PROTESTS' On Jan. 20, C-SPAN covered one-and-a-half hours of the inaugural parade without commentary. This allowed viewers to clearly hear the thunderous cacophony of the dissenting protesters on TV and on C-SPAN's Web site. However, C-SPAN was the exception rather than the rule. During MSNBC's inaugural coverage, one commentator could be heard saying,

White House spokesman Ari Fleischer said yesterday that President George W. Bush would appoint Marc Grossman, a former ambassador to Turkey and career diplomat as undersecretary of state for political affairs, to the No. 3 position at the State Department, and Richard Haass as director of policy planning with the rank of ambassador. Grossman has been a long-time proponent of a strong Israeli-Turkish alliance and has held various positions in the State Department, including several in the Bureau for Near East and South Asian Affairs. He is admired in the pro-Israel community. Haas, a former special assistant to president George Bush and senior director for Near East affairs on the National Security Council, has advocated a gradual, step-by-step approach in Israeli-Palestinian peace negotiations. He has been critical of US sanctions against Iran and was a formulator of US policy toward Israel when Likud prime minister Yitzhak Shamir tried to make his participation in the Madrid peace conference conditional on $10 billion in loan guarantees to help cover the cost of absorbing Soviet Jewish immigrants. Haas, who is currently vice president and director of foreign-policy studies at the Brookings Institution, is remembered for advocating a tough stance toward Israeli settlement construction while an adviser to Bush. With the closure of the office of special Middle East coordinator, Haas is expected to assume a beefed-up role in fashioning Middle East policy for the new administration. He will work with William Burns, currently ambassador to Jordan, who is expected to replace Ned Walker as assistant secretary of state for Near East affairs but has not been officially named to the post. Even more crucial than Haas or Grossman in developing Middle East policy, however, is likely to be John Hannah, who recently was selected by Vice President Dick Cheney to be his Middle East adviser. Cheney is expected to wield enormous influence on both foreign and domestic policy, and has assembled a wide advisory staff that includes numerous regional experts. Hannah, who has been described as a discreet but formidable analyst, has worked twice at the Washington Institute for Near East Policy, a leading Middle East think tank. Still conspicuously vacant among Bush foreign-policy appointments is the important No. 2 slot at the State Department, deputy secretary of state. In his victory speech, Sharon said Israel was embarking on a new path of "security and true peace," reinforcing his campaign message that he will provide security for Israel while continuing to negotiate peace with the Palestinians. The ex-general, nicknamed "The Bulldozer," gave his victory speech three hours after Israeli TV exit polls projected his landslide victory. It was a stunning comeback for the 72-year-old Likud party leader, whose election was once thought nearly impossible. He also surprised his supporters by saying he would resign his seat in the Knesset, Israel's parliament, step down as head of the Labor Party as soon as a new government was formed and retire from politics for now. But Barak said his pursuit of peace with the Palestinians was the "one and only true path" and that his government was ahead of its time. "Friends, we have lost a battle but we will win the war," the 58-year-old Barak said. (More on Barak's concession speech) Many Israelis were turned off by both candidates and their disgust was reflected in the turnout, estimated by Israeli election officials to be around 62 percent of the 4.5 million eligible voters. That is a sharp drop from the 1999 election turnout of 78.7 percent. Israel's voting average of close to 80 percent is among the democratic world's highest. Arab Israelis, traditionally supporters of Barak's Labor Party, apparently boycotted the election as voter turnout was low throughout all Israeli Arab villages, according to the Israeli-Arab Center for Equality. Arab Israelis were angered by the fatal shooting of 13 Israeli Arabs by police during riots in October. Winner must balance Knesset factions Once official results are announced on February 13, Sharon will have 45 days to form a new government. Barak remains prime minister in a caretaker role until Sharon assumes office. Sharon also must work with a deeply divided Knesset whose members did not face Tuesday's election, which was the first in which Israeli voters elected only the prime minister. His first big hurdle will be passing the 2001 budget, which must be approved by the Knesset by March 31. "Absent a strategy, absent any follow-up, [airstrikes] strengthen Saddam Hussein in the region and his own country," said Wolfowitz, who served as a top Pentagon official during the Persian Gulf war before becoming dean of the Johns Hopkins Paul H. Nitze School of Advanced International Studies in Washington. Wolfowitz was among those who favored creating a haven in southern Iraq where opposition groups and renegade Iraqi soldiers could regroup, possibly under the protection of the U.S. military. Now he will have a chance to mold such policies from the Pentagon. President Bush said yesterday that he would nominate the quiet and cerebral Wolfowitz to the No. 2 post at the Pentagon, where he would serve as deputy to new Defense Secretary Donald H. Rumsfeld. The position requires Senate confirmation. Wolfowitz, 57, of Chevy Chase, was one of candidate Bush's top foreign policy and defense advisers and was a frontrunner for the top Defense job. But some Bush advisers said Wolfowitz lacked the managerial skills to run the sprawling Pentagon, which has overwhelmed many seasoned bureaucrats with its battling fiefdoms and complex weapons programs. A New York native who studied mathematics and chemistry at Cornell University before earning a master's degree and doctorate in political science at the University of Chicago, Wolfowitz worked for President Reagan as head of policy planning at the State Department before becoming assistant secretary of state for East Asian and Pacific Affairs. In 1986, Reagan appointed Wolfowitz as U.S. ambassador to Indonesia, a post he held until 1989. In the previous Bush administration, Wolfowitz served as undersecretary of defense for policy planning. Wolfowitz played an important role when the U.S.-led coalition went to war in the Persian Gulf region in 1991 to drive Iraqi forces out of Kuwait. As Iraqi Scud missiles struck Israel, Bush sent him to help persuade Israel not to retaliate, which could have upset the coalition's Arab partners. It was a delicate mission, but ultimately proved successful. Since becoming dean at SAIS in 1994, Wolfowitz has weighed in frequently on national security issues. He urged greater support for Iraqi opposition groups in their quest to oust Hussein. And he echoed the concerns of others that North Korea, Iran and other so-called rogue states were building missiles that could strike the United States. Three years ago, when Rumsfeld headed a commission that spotlighted such dangers, he found an ally in Wolfowitz. The CIA was "wrong" in minimizing the threat, Wolfowitz told The Sun. The spy agency, he argued, underestimated the role played by foreign trade and technology transfers in helping potential aggressors develop ballistic missiles capable of reaching American soil. "People who want these things can get these things," he said. "He's definitely a policy guy. The warning came as Israeli soldiers tried to tighten their grip on the West Bank and Gaza Strip before the "day of rage" which leaders of Yasser Arafat's Fatah movement say marks the start of an intensification of the four-month uprising. The army fired rocket-propelled grenades into the Palestinian refugee camp of Rafah, on the border between Gaza and Egypt, after an Israeli soldier on his way to vote in the early ballot staged for the army was killed by a bullet fired from the camp. The U.S. brigade from the 69th Air Defense Artillery arrived in Haifa and is preparing for an exercise, called Juniper Cobra. The exercise â beginning Thursday and lasting 14 days â is one component of plans to increase U.S.-Israeli defense coordination amid threats of regional war that could involve Iraq and Syria. -- -- January 26, 2001 - Patriot anti-missile battery deployed to Israel -- -- The sources described Israeli, Iraqi and Lebanese military movements over the weekend. In Lebanon, the Hizbullah movement deployed short-range rockets near the Israeli border. Arab military sources said Israel and Hizbullah have beefed up their forces near the border with Lebanon. JERUSALEM, Feb. 7 â Right-wing hawk Ariel Sharon proclaimed âa new pathâ for Israel on Wednesday after crushing the liberal Prime Minister Ehud Barak in Tuesdayâs election. Sharon, a former general noted for his hard-line stance on Palestinians, won a staggering 62 percent of the vote in an Israel grown weary after five months of Israeli-Palestinian clashes. In Sharonâs promise to the Israeli public of âa different kind of peace process,â some saw hope for unity, while others saw only the potential for even greater conflict. âTHE STATE OF ISRAEL has entered a new path ... the path of security and true peace,â the 72-year-old Sharon told cheering, chanting supporters at his campaign headquarters early Wednesday. He called on Palestinians to abandon âthe way of violenceâ and urged his vanquished opponent, Barak, to join forces with him in a broad-based national government. Sharon, 72, also said U.S. President George W. Bush had called to congratulate him and to urge close cooperation. Later he said that heâd also received a call from Secretary of State Colin Powell and that Powell and the U.S. president had said they would help continue peace process. With 99 percent of the vote counted, Sharon had 62.5 percent of the vote to Barakâs 37.4 percent, an even wider margin than predicted by exit polls that had given Sharon 59.5 percent. After Israeli television released the results of the exit polls, Sharonâs supporters in Tel Aviv whistled, clapped and blew horns, waving blue-and-white banners. âThe end of Oslo!â some shouted, referring to the interim peace accord that Sharon has always opposed. Sharonâs victory speech was characteristically tough and uncompromising, NBCâs Martin Fletcher reported, but the Likud Party leader did leave the door open to resume peace talks. Sharon said a peace agreement ârequires difficult compromises from both sides,â but did not say what concessions he was willing to make. Turning to the Palestinians, Sharon urged them to âto abandon the path of violence and return to the path of dialogue and solving the problems between us by peaceful means.â However, he suggested that Jerusalem would be off-limits in future negotiations. âThe government I shall form will work to strengthen and build the united Jerusalem, Israelâs capital and the capital of the Jewish people for all eternity,â Sharon said. Speaking of Jerusalem in his speech Wednesday, Sharon quoted a biblical verse often cited to express Jewish ties to the city: âIf I forget thee, O Jerusalem, may my right hand wither.â The Palestinians want the traditionally Arab East Jerusalem as a capital for a future Palestinian state. Barak had agreed to hand at least some of the Arab neighborhoods over to Palestinian control, but the deal was rejected by Palestinian leader Yasser Arafat and Barakâs government fell apart over his even making the offer. Several weeks later, a visit by Sharon to a Jerusalem site holy to both Muslims and Jews sparked Palestinian riots, the beginning of months of violence that became known as the âAl-Aqsa intifada.â The prospects for talks that exclude compromise on Jerusalem appeared dim. After Sharonâs victory speech Palestiniansâ chief negotiator Saeb Erekat countered that any talks would have to resume where they broke off under the Barak â meaning Sharon would have to adopt positions he has bitterly opposed. âWe cannot go back to point zero,â Erekat said. Monday February 5 4:52 PM ET Rule to Ban Road Development in Forests Hits Snag By Christopher Doering WASHINGTON (Reuters) - The Bush administration has delayed until May 12 a plan by former President Clinton (news - web sites) to ban road construction and timber harvesting on nearly 60 million acres of forest land, the government said on Monday. The new regulations are among several that were put on hold by President George W. Bush (news - web sites) immediately after he was inaugurated on January 20. The announcement of the decision appeared in Monday's Federal Register, the government's official log. The roadless rule along with other delayed regulations is undergoing a 60-day review by Bush administration officials. The ban, approved by Clinton two weeks before he left office, would restrict road construction and the removal of oil and lumber in 58.5 million acres (23.67 million hectares) of forest land, unless it was necessary for environmental reasons or to reduce the risk of wildfires. ``Currently, the department is reviewing a number of regulations in accordance of the guidelines set forth on January 20 with the temporary 60-day delay,'' said Kevin Herglotz, a spokesman for the U.S. Agriculture Department. ``No decisions have been made yet on'' the roadless rules plan, he said. The final roadless plan was issued by the Forest Service, which is part of the USDA, in January. The former Texas governor and other Republicans have lobbied to open land such as the Alaska's Tongass National Forest, which would be protected as part of the roadless rule. Still, it is unlikely Bush will have much success in overturning the roadless ban because it is already a rule of law. Regulations become law once they are printed in the Federal Register. Environmental groups say the road ban is needed to protect unspoiled forest and animal habitat from ``irreversible damage.'' Some groups are worried that Republican lawmakers such as Sen. Larry Craig (news - bio - voting record) of Ohio or Sen. Frank Murkowski (news - bio - voting record) of Alaska could find alternate ways to derail the roadless rule. Murkowski, who heads the Senate Energy Committee, predicted in January the roadless ban would be challenged in court or reviewed by Congress because of alleged violations committed during the rulemaking process, such as improper notice of public sessions. One option is through the Small Business Regulatory Enforcement Fairness Act of 1996. The act, which has never been used, allows for a regulation to be voted on by Congress if its impact on the economy exceeds $100 million per year. If both the House and Senate were to vote against the roadless act, the president could then kill the regulation, according to environmental groups. This is a move by ``the Bush administration and the timber industry's allies in Congress to give themselves time to develop a strategy on how they are going to stop wild forest protection,'' said Sean Cosgrove, a forest policy specialist with the Sierra Club (news - web sites). ``It would be foolish to attack (the plan) and take it apart. I don't think they want the fight,'' he said. Harris Washington Post Staff Writer Wednesday, February 7, 2001; Page A1 They were two political partners who had barely spoken for a year, but a few days after Al Gore conceded the 2000 presidential election, he and Bill Clinton were finally talking face to face. For more than an hour, in what sources close to both men described as uncommonly blunt language, Gore forcefully told Clinton that his sex scandal and low personal approval ratings were a major impediment to his presidential campaign. Clinton, according to people close to him, was initially taken aback but responded with equal force that it was Gore's failure to run on the administration's record that hobbled his ambitions. The White House meeting, which Gore sought, was a doleful postscript to a relationship that once was exceptionally close but had deteriorated badly over the course of Gore's 2000 race. Its significance, however, was more than personal. The question the two men were debating why did Gore not capture the White House? is the same one confronting Democrats broadly as they assess the lessons of 2000. If Gore hopes to seek the presidency again, moreover, several Democratic strategists say he will almost certainly need to establish a better footing for his relationship with Clinton who remains a powerful figure within the party despite the blunders that marked his exit from the White House. Only Clinton and Gore were present for the showdown session, which never appeared even on internal schedules distributed to White House staff. But people close to both have described its tone in similar language. "Tense" was the description of one adviser to Clinton, while a Gore aide called it "cathartic." One Democrat who has worked closely with both men called the session "very, very blunt." Where descriptions differ is on the conclusion of the meeting. Some Democrats who heard descriptions from one or the other of the two participants said the meeting essentially ratified what for many months had been an unspoken truth between the two men: Their relationship suffered irreparable harm in the wake of the Monica S. Lewinsky scandal and Clinton's lies to Gore and the nation about it. Gore, said one Democrat, "seemed eager to get things off his chest." Others put a more upbeat cast on the session, calling it a useful air-clearing that should allow the two men to move forward. "They had to cover a lot of territory," said one Democrat close to Clinton and Gore. "My impression was it was a very constructive meeting." "He felt it was a very good conversation," said one adviser to the former vice president. Jake Siewert, a spokesman for Clinton, and Kiki McLean, a spokeswoman for Gore, said their bosses would not comment on a private conversation. Gore and Clinton saw each other several times after the talk but before the end of the administration and also spoke by phone; aides said these conversations were polite, but not consequential. And they have not come close to finding common ground on why Gore is not president today. In fact, on this large issue and several minor ones, there are open wounds between the camps of Democratic aides allied with one man or the other resentments that have been rubbed anew since Jan. 20. Many Clinton advisers were infuriated by a post-election analysis Gore consultant Carter Eskew published Jan. 30 in The Washington Post in which he said the "deep dissatisfaction and anger" felt by swing voters over Clinton's scandals was "the elephant in the living room" preventing Gore from making his case. A senior White House official close to Clinton scoffed: "I don't think the fact that they lost four out of four debates had anything to do with Bill Clinton." By this reckoning, neither Gore nor his running mate, Sen. Joseph I. Lieberman (D-Conn.), made a compelling case in showdowns against President Bush and Vice President Cheney. As a general rule, aides close to Clinton say, he was less upset than often reported by Gore's efforts to distance himself publicly from the president. And, with the exception of the last 10 days or so of the general election when he desperately wanted to hit the road in key states but was told no by the Gore campaign he did not expect a significant role as a Gore proxy. But he was mystified, and at times angered, by Gore's refusal to run on the strong economy and other issues in which Clinton felt both he and his vice president deserved credit. They fear that current treatments and experimental vaccines will prove ineffective against this new form of the deadly virus. It was first detected in blood samples taken from an Aids patient in Cyprus who died in 1998. However, a medical team in Seoul, South Korea, has announced that they have detected the same form of the deadly virus in a 33-year-old female with Aids who died in 1997. Professors Choi Kang-won and Oh Myong-don, of Seoul National University (SNU), said the HIV collected from the blood of the woman had a totally different gene structure than the usual form of HIV. However, it was the same as the samples taken from the patient in Cyprus. New vaccines needed Professor Choi said: "The outcome of our research shows that a new variety of HIV exists in the nation. "We, therefore, need to develop Aids vaccines to cope with new types of HIV." Professor Choi said the Korean woman had worked as a prostitute in the southern port city of Pusan. This could mean that other people had already been infected with the new form of the disease. The US and South Korean teams are expected to give more details of their discovery at the 8th Conference on Retroviruses and Opportunistic Infections being held this week in Chicago. Professor Choi stressed that new virus was not a mutation of other HIV strains. He suspects that the new form of the virus may have originated in Africa. According to the United Nations, 36.1 million people either had the HIV virus or had developed Aids by the end of 2000. Several experimental vaccines for HIV are currently undergoing tests world- wide. However, there are not effective for all forms of the disease. There are two recognised forms of HIV, known as HIV-1 and HIV-2. It is thought that the newly discovered form is a sub-type of HIV-1. Mutate rapidly Mark Graver, of the UK HIV charity Terrence Higgins Trust Lighthouse, said: "Because of the class of viruses to which it belongs and its rate of reproduction, HIV-1 can mutate particularly rapidly. "This is one of the reasons why anti-HIV combination therapy can fail if a person is not able to take their medication correctly. "HIV reproduces in the presence of the drugs and can mutate to become insensitive to them. "Apart from drug-resistant mutations of HIV-1, there are a number of different variants or strains of HIV-1 known around the world. "Some of these strains are more common in one country than in another. "Any vaccine which is developed to give immunity to infection will, of necessity, have to be active against all these possible variations and mutations of HIV-1." Federal prosecutors are investigating herbal remedy marketer Almon Glenn Braswell for possible tax evasion and money laundering, a federal law enforcement source in Los Angeles said Tuesday. Braswell, 57, was among 140 people Clinton pardoned on Inauguration Day. The pardon, which covered Braswell's 1983 conviction for fraud and other crimes, restored his civil rights. "No one knew of any ongoing criminal investigation'' at the time of the pardon, Clinton's office said in a statement. The former president's office also said, "No one at the White House who reviewed this matter had any intention of the pardon covering anything other than the infraction from 1983.'' U.S. News World Report first reported on the pending criminal investigation during the weekend. After the pardon was announced, some federal officials worried that Clinton might have pardoned Braswell for any criminal charges that could arise from the current investigation. However, Clinton's one-page pardon states that Braswell is receiving an executive grant of clemency for "his convictions ... on three indictments for which he was sentenced on Dec. 5, 1983.'' Braswell's conviction stems from false claims about the effectiveness of a treatment for baldness. He was sentenced to three years in federal prison followed by five years' probation. The meeting was announced late Monday after a one hour meeting between the two sides at the presidential palace here, and following a day in which three Indians were killed and 29 others wounded in clashes between protesters and security forces. The breakthrough was announced by Nina Pacari, a political spokeswoman for the Confederation of Indigenous Nationalities of Ecuador (CONAIE). There was no immediate confirmation from the government. "Under a compromise worked out at the meeting, police have already begun to withdraw from the Salesian Polytechnic University," she said. The local university was the site of a clash earlier Monday between security forces and Indians who have occupied the campus since January 29. Moving in on foot and horseback, about 80 police used tear gas to try to remove some 6,000 protesters, but were repelled by Indians brandishing wooden spears posted at entrances to the campus. That confrontation followed the deaths of three Indians during an operation by security forces to forcibly remove about 700 protesters blocking a bridge at Puerto Napo, 120 kilometers (75 miles) southeast of Quito, according to Red Cross officials. The Indians are protesting scarcity measures imposed at the start of the year, including a 100 percent hike in the cost of fuel and 75 percent rise in public transportation costs. They are also protesting the replacement last year of the local currency, the sucre, with the US dollar. The dollarization process was accompanied by 91 percent inflation. Noboa had declared a state of emergency Friday following the collapse of negotiations, after Indians demanded to meet with him and he refused. Representing the Indians in talks with Noboa Tuesday will be Antonio Vargas, the 40-year-old president of CONAIE, who was a key player in a coup d'etat on January 21, 2000 which toppled then-president Jamil Mahuad. Backed by 10,000 Indians who flooded downtown Quito, Vargas was part of a three-member civilian-military government that lasted only four hours before handing power over to Noboa, Mahuad's vice president. Though Noboa, by all accounts, has the support of the military in defending against the indigenous uprising, his popularity among Ecuador's civilians is declining rapidly. Noboa began his mandate in January, 2000, with 51 percent of the country backing him. In a poll released Monday, however, his numbers had plummeted to just 28 percent, with 54 percent of Ecuadorans registering support for the indigenous protests. Barbara Graham, the Washington Post reported Thursday, "was found guilty in D.C. Superior Court S of trying to avenge her son's death by shooting a young man" last year that "she blamed for the killing." Graham, who lost her own son in 1999 in a shooting death at a Martin Luther King, Jr. rally, became active in a Washington-area group, "Mothers on the Move Spiritually," in the months following her son's death. The group helped sponsor the MMM event, where Graham "spoke out S and helped memorialize the dead," the paper said. The Million Moms March, which becomes nine months old as an organization Feb. 14, has become one of the nation's leading advocates of stringent gun control. The group, which promotes gun-control activism among the nation's mothers, says it is "dedicated to preventing gun death and injury and supporting victims and survivors of gun trauma." Specifically, the organization promotes nationwide gun registration and wants to "close gun show loopholes." Also, it supports a "one gun purchase a month" program, and "strict oversight of the gun industry," among other measures. Officials with the group, which has its main office in San Francisco General Hospital, did not return phone calls on Friday seeking comments about Graham's involvement with the Mother's Day speech or her conviction. According to the Post, jurors last week returned guilty verdicts on nine counts against Graham, 49, for her Jan. 26, 2000, shooting of Kikko Smith, age 23. The shooting has left Smith paralyzed and confined to a wheelchair for life. Smith has spent most of the past year in a hospital, said the Post account. Witnesses said Graham, who has three living children and who was distraught over the loss of her son and frustrated with police efforts to catch her son's killer, went to Smith's house with her son's .45-cal. handgun and 30-year-old Erskine Moorer, the boyfriend of one of Graham's daughters. When they arrived at about 6 p.m., Graham twice asked Smith -- who had been called outside by friends and was talking to them as they sat in their car -- his name. Prosecutors said Graham and Moorer then pulled out guns and began shooting at Smith as he ran from them. However, the Post said, Moorer's attorney, Douglas Wood, told the jury that his client had left the neighborhood before the shooting. "Asked who confronted him with a gun, Smith pointed emphatically to Graham, who sat still and somber. At another point, he pointed firmly at Moorer, saying Moorer joined the ambush as he ran from Graham," the paper said. Prosecutors said during the trial that Graham likely confused Smith with another young man with a similar-sounding name, and that Smith was not the one who shot her son in 1999. Democrats Expose Themselves Linda Bowles Feb. 6, 2001 The horrendous fight over the nomination of John Ashcroft to become attorney general of the United States was a good thing. It was an important victory over the forces of radical liberalism. It exposed ruptures and fault lines in the ranks of the Democrat Party. And it demonstrated that Senate Minority Leader Tom Daschle no longer has the iron-fisted control that he exercised time and again during the last eight years. The vote was 58 for Ashcroft and 42 against. As is their wont, the Democrat leaders declared victory after losing. They claimed they had achieved everything they wanted in the nomination fight. They said their opposition was a "shot across the bow" to keep Ashcroft "honest" and to warn President Bush what would happen if he dared to nominate a conservative judge to the Supreme Court. These assertions are rationalizations. In the first place, Ashcroft is already "honest." That is one of the problems they have with him. And President Bush already has the 51 votes he needs to confirm his choices for the Supreme Court. Democrat threats of a filibuster are hollow. They will not want to run the risk of being seen as partisan obstructionists. The Democrats did not fire shots to deliver a warning; they fired shots to sink the ship. They wanted to destroy Ashcroft just as they destroyed Judge Robert Bork. The inflammatory lies and innuendoes Ted Kennedy used against Ashcroft are echoes of his infamous accusations against Supreme Court nominee Robert Bork. His words against Bork ushered in a new era of McCarthyism. They are worth repeating for their historic value and to provide insight into how liberals execute the politics of personal destruction. On the Senate floor in 1987, Edward Kennedy said, "Robert Bork's America is a land in which women would be forced into back-alley abortions, blacks would sit at segregated lunch counters, rogue police could break down citizen's doors in midnight raids, schoolchildren could not be taught about evolution, writers and artists would be censored at the whim of government, and the doors of the Federal courts would be shut on the fingers of millions of citizens for whom the judiciary is often the only protector of the individual rights that are the heart of our democracy." But this time, the scurrilous demagoguery of guilt by association, the mass protests, the lies and the manipulation did not carry the day. The best efforts of the paid character assassins and the Democrat nightriders did not prevail. This time it didn't work. Perhaps the greatest value of the confirmation brawl was that it brought into clear view that a majority of Democrat senators are, when the chips are down, little more than puppets of special interest groups organized around left-wing zealotry. Who are the puppeteers pulling the strings? We now have a list. On Jan. 30, 2001, Mark Levin, president of the Landmark Legal Foundation, sent a letter to Sen. Patrick Leahy with questions about the closed meeting between Democrat Senate staffers and a group of "over 200 national organizations opposed to the nomination of former Senator John Ashcroft for attorney general of the United States." Levin noted, "Among other things, the group established a lobbying committee." According to Federal law, organizations that receive federal funds are prohibited from lobbying activity. Nevertheless, at least 18 of the organizations present at this anti-Ashcroft meeting received more than $150 million in federal funds over a four year period from 1996 through 1999. Among these 18 organizations are some familiar ones, including the American Bar Association, American Federation of State, County, and Municipal Employees, National Association for the Advancement of Colored People, National Council of Jewish Women, National Education Association, NOW Legal Defense and Education Fund, Planned Parenthood and the Sierra Club. Levin asked Sen. Leahy "whether these non-profit organizations, with your encouragement, are using tax-exempt funds or federal funds to lobby senators." Levin sent copies of his letter, with exhibits, to the Internal Revenue Service, the Tax Division of the United States Justice Department and the Senate Select Committee on Ethics. It has now been made perfectly and irrefutably clear that what these organizations have against Ashcroft is not that he is a religious man, but that he takes his religion seriously. Therefore, Congress is set to hold investigative hearings this week into the possibility of Clinton administration corruption. I know what you are thinking. Where were these guys when we needed them? Well, it gets worse. The hearings to be held in the House and Senate are to focus on Clinton's 11th-hour pardon of fugitive commodities trader Marc Rich. There's no doubt Rich is a scoundrel. He fled the country and renounced his citizenship when faced with a 65-count indictment for conspiracy, tax evasion and trading with the enemy. He was convicted in absentia on 51 counts. It also appears obvious that Clinton pardoned Rich as a quid pro quo for hundreds of thousands of dollars in campaign contributions funneled to Hillary Clinton, Al Gore and other Democratic Party candidates. I suppose I should be thankful that some members of Congress have awakened finally to the depths of blatant Clinton administration corruption. But I can't help feeling that these inquiries are way too little, way too late. Sen. Arlen Specter, R-Pa., is leading one of the probes. Think about that irony. Specter bent over backwards, citing Scottish law, in his intellectual and legal gymnastics attempting to explain why he was voting against convicting Clinton during the impeachment trial. His vote came after his wife got an appointment to the Clinton administration. And he's going to judge whether Clinton took a bribe to pardon Rich? Many of us out here in America -- outside of Washington, D.C. -- couldn't understand why the Congress failed to investigate Clinton administration corruption adequately during the last eight years. It was as if Congress had abdicated its oversight role and forgotten that it represented, at least, a co-equal branch of government with the executive -- and, more importantly, the people's voice in the federal system. It seems like odd timing to begin worrying about Clinton now that he's gone. And bribery will be a tough case to make -- no matter how obvious it appears to any of us. If Congress couldn't convict Clinton on perjury during impeachment, does anyone really expect anything but some hot air from these hearings? Furthermore, as much as I hate to say it, the Constitution does give the president wide berth on the issue of pardons. There's no need for approval by Congress or anyone else. You see, Congress had its chance. Most members -- even in the Senate -- knew what Clinton was when they voted on impeachment. They knew he was corrupt. They knew he was a criminal. They knew he had repeatedly broken the public trust. They knew he had no respect for the law. They knew he believed only in himself and what was good for Bill Clinton. They knew he had no scruples, no conscience, no ethics, no morality. They knew if he got away with perjury and much more serious crimes for which he wasn't impeached, that he would continue his criminal escapades. Well, guess what? Clinton did just that. And the Rich pardon was only the latest insult added to many injuries Bill Clinton inflicted on America's body politic. I wish Congress well in investigating the Rich affair. The American public does deserve to know the truth. The problem is that Congress has been woefully ineffective in such half-hearted investigations during the Clinton years. So, my hopes that justice will be served and that the public will be informed are somewhat dim, to say the least. I'm just trying to figure out where all this outrage is coming from at this late date. Where was the outrage when Clinton was selling national security down the drain for Chinese political campaign contributions? Don't they get it? After eight years, don't these people understand Clinton would sell anything that wasn't nailed down to anyone with money in his hand? Like any other red-blooded American, I'd like to see Marc Rich pay for his crimes. But that's not going to happen. More importantly, I'd like to see Bill Clinton -- and all those around him who were complicit in their guilt -- pay for the pattern of official criminal activity of the last eight years. The action hero didn't quite use the ``T'' word in a phone conversation with Los Angeles Times political columnist George Skelton, published on Monday, but his intent seemed clear. Skelton said that a recent column he wrote about Davis' reelection prospects following criticism of his leadership in the state's energy crisis got Schwarzenegger so excited that he called last week from the set of his latest movie. Schwarzenegger, a Republican, told Skelton that more decisive leadership was needed in California. ``It comes down to leadership. You have to take risks and be able to just say, 'I've taken my best shot.' And that is what is lacking,'' Schwarzenegger said. ``It's upsetting to everyone right now ... People are taking their companies out of state because they're worried (about electricity) ... And then someone cannot make up their mind what they really want to do ... You cannot make great decisions if you're just worried about your reelection.'' Schwarzenegger added that if Davis couldn't turn things around he could see himself following in the footsteps of former President Ronald Reagan (news - web sites) who left a film acting career for politics when he was elected Governor of California in 1966.
