Did you see my proposed constitution? I tried to address these concerns
by mostly codifying the way I thought the list had been handled so
far (more or less) with a couple minor details inserted. The only
really serious thing I added was the provision for a formal vote when a
consensus could not be reached. This is useful, since it helps to form
consensus when there is one person dissenting and preventing consensus,
this person knows that they will lose a vote anyway so they might as
well consent. Also, I think it leaves a lot of room for judgement by the
community and will therefore be easy to adapt to any changing situation.
Here it is again, in case you missed it:
1. The Listowners are responsible for solving any technical problems
Members may have with their subscription.
2. All Members, including Listowners, may express their thoughts on any
subject, including the conduct of other Members.
3. If the Members come to a consensus that another Member is abusing his
or her list posting privileges, then the Members may choose a delegate
to formally warn this offending Member to cease these abuses.
4. If the Members come to a consensus that another Member who has
previously been warned is continuing to abuse his or her list posting
privileges, then the Members may ask the Listowners to ban the offending
Member.
5. When it is impossible to form consensus on a subject, a vote of all
Members, including Listowners, may be called if requested by a Member
or Listowner and accompanied by a petition of at least 10 Members or
Listowners. The request and petition should include:
a) a statement of the matter to be decided by vote
b) the logistics of how the vote will be handled
c) who will officially report the results
d) what numerical outcome is necessary for the vote to be decided
definitely, which as a minimum should be at least 20 Members or
Listowners casting a vote
e) the time period of the vote, which should be at least 7 days
