What this states but doesn't make clear is that the heavy equipment
credit is designed for companies that need to update old equipment. Many
companies are using outdated equipment that did much more damage to
environment that newer ones.

Accountants took advantage of the law and assisted people in creating
corporations that did nothing so that they could purchase the vehicle.

Keep in mind that you could theoretically use both laws, if you
purchased a hybrid over 3 tons you could write off that purchase and get
the clean air tax credit.
