Gruss, With all due respect, you'd be making a complete fool out of yourself if you were arguing these points in a legal forum. There, attorneys would tear your notions apart and perhaps dissuade you from pursuing a legal career.
I just wish you would spend a lunch with a competent attorney and talk a little bit about the very most basic concepts of law and trial.
