Actually, it is determined by Federal labor laws regarding exployee classification. Two categories Exempt and Non-Exempt. Non-Exempt employees are usually hourly employees, non-management and if your company has more than 10 of then, you are required by Federal law to pay overtime for more than 40 hours a week.
