In this state a restaurant is considered a public place. A public place here
is one that is open to the public. The text of the new law bans smoking in
enclosed public places. It defines a public place as one opened to the
public.

Restaurants will always have regulations, they serve food, while you don't
have to eat at one, they still have to serve properly prepared food in a
clean and safe environment.

It is perfectly legal for me in my home to eat raw chicken; however there
are health codes against a restaurant serving raw chicken.

It is perfectly legal for me in my home to refuse to serve somebody based on
their race; there are discrimination laws that prevent a restaurant from
doing this.
