Well we're not talking about whether or not it affects your land, we're only talking about whether the government should or should not govern a private business. By your logic, you're saying that it's more important to keep the air around your private business fresh and clean rather than the air that is invading someone's lungs. I don't consider the air to be an "owned" (by private business, that is) commodity as you're suggesting. When your smoke crosses into my breathing space, it's become your responsibility to rectify the situation. And that's the crux of the problem - people doing things that affect other people without regard.
I think we should remove the way of thinking "We're telling a business what they can and cannot do" to "We're telling people that they can't affect other people without their permission". The business doesn't smoke, people do, and therefore the law only is affecting people, not businesses.
