Fortunately we now use a Registrar that does allow us to do this. One of
three Registrars that I am aware of that allows this practice. There are
probably more than three, I haven't reviewed the policy of everyone out
there.
We haven't registered any new domains with OpenSRS since May, so we should
not have any remaining liability from domains registered with OpenSRS, as
most banks restrict charge backs to two months, a few to six months.
As to why we should be able to take the domain name in the event of a charge
back is very simple for everyone but you to understand. We paid for it.
The client did not pay for it, NSI Registry did not pay for, OpenSRS did not
pay for it, we paid for it.
Plus it states under the FEE SECTION of our registration agreement that the
client gives us the right to assume ownership of the domain and to recover
any costs of a charge back or bad check, including attorney fees prior to
returning the domain name to them.
And I have yet to hear of any offer from OpenSRS to refund the $4.00 that
they keep for processing the transaction in the event of a charge back.
(Note: I'm not asking that they return any money, just the domain name that
belongs to their RSP. The $4.00 is a minor loss when compared to the charge
back fees from the merchant account.)

And the NSI-Registry would not lose the fee paid it by the NSI
Registrar.

No, not at all. If NSI-Registrar can't take possession and auction
off unpaid domains, why should you be able to?
