Not if you can provide evidence to OSRS that payment for
the domain was withdrawn.  They can put the domain on
"Administrative Hold" so that it is unusable.

But, to be clear, "if someone doesn't pays you" sounds like
you're asking about someone not writing you a check AFTER
you've already registered the domain name.  In *THAT* case,
probably yes, they get to have the domain name, because
you chose to take the risk and not get paid up front.
