The below paragraph is copied from “Guide to the implementation of directives based on the New Approach and the Global Approach” “The CE marking shall, as a rule, be affixed to the product or to its data plate. In addition, it can be affixed, for instance, to the packaging or to the accompanying documents. However, it may exceptionally be moved from the product or its data plate if this rule cannot be followed. This would be justified where affixing it to the product was impossible (for example on certain types of explosives), or not possible under reasonable technical or economic conditions, or where the minimum dimensions could not be respected, or it could not be ensured that the CE marking was visibly, legibly and indelibly affixed. In such cases, the CE marking has to be affixed to the packaging, if it exists, and to the accompanying document, where the directive concerned provides for such documents. The CE marking on the product may neither be omitted nor be moved to the packaging or accompanying documents on purely aesthetic grounds.” With this I interpret that if the CE mark of min 5mm height cannot be affixed on the product, then it can be affixed on the packaging or accompanying documents. Meaning the 5mm height still has to be fulfilled. All the response is not going convince the management guys. A real life case of penalty (or some sort of prosecution case) would be more effective in putting the message across. Anyone able to provide cases of it. This bring me to another scenario, if product (size is big enough for the CE mark) bears CE mark lesser than 5mm, but packaging carries the correct size CE mark? So in such case, how do you view it. Clif, Do you still happened to kept of any of the custom authorities replies on the case that you mentioned? If yes, are you able to forward to me separately (off the group), if you don’t mind? The device had a surface area of 15cm^2 The mark was about 3mm, and the action was resolved with an agreement to correct the label on future shipments. Customs officials are watching for it. A device isn't compliant without a proper CE mark. The shape and size are regulatory requirements. The case where you could make an effective argument to delete it would be the rare exception in my opinion.. Such as some electronic products, toy product and on my desk a stationary highlighter, all which have CE mark of about 3mm height. Isn’t this deem not meeting to CE mark logo specs/requirement? Is there any cases of penalty that anyone can provide so that I could use it to show to our management guys. Thanks.
