From the Commission's " Guide to the implementation of directives based on the New Approach and the Global Approach":
"According to the Directives relating to machinery, personal protective equipment, active implantable medical devices, medical devices, potentially explosives [sic] atmospheres, lifts (as regards safety components), in vitro diagnostic medical devices, and radio and telecommunications terminal equipment the minimum dimension of the CE marking may be waived for small devices." I'm also sure that somewhere I've seen a rule which says that if the largest dimension of the product is less than 150mm the size of the logo can be reduced from 5 to 3mm, but I can't find where that comes >from in a quick look this morning, and it's not in the Directives so it's only a guideline anyway. I think it may be an adaptation of the marking requirements from one of the LVD standards. I have seen incorrect size of the logo cited in safeguard actions under the LVD, but only where there are other, more substantial, problems with the product. I very much doubt it would ever be used as the sole basis of action, but it's part of a general picture which the enforcement people use to determine whether or not a product is worthy of closer investigation.
