Well it's all fine and dandy to say this, but you have no way of enforcing it. If the seller wants to keep the OS disk, or maybe it was destroyed or lost (not unheard of), and the buyer wants the machine regardless of whether he gets the disk or not, a deal will be made. > > Yes indeed, it is reasonable that a used Mac have an OS installed. But if > the OS media does not come with the machine, part of the deal is missing! Not really. Can you not sell a machine without the keyboard that originally came with it? Once again, if both parties agree to it, then there's the deal. > That media is "part of the purchase price" unless explicitely agreed to > otherwise. Can you show me where it says this? That I'm legally bound to purchase an OS and install it on my newly acquired machine? > So what happens to the media that should have come with the Mac? The former > owner kept the legal media for use on another Mac and made the sold machine > illegal. Just because the machine was sold without an OS disk does not make it "illegal"! I have actually purchased two machines, one a Mac and one a PC, from authorized resellers, with systems installed but no OS disks included. Or the former owner made the Mac illegal in the first place by > loading an OS from a CD that belonged to another Mac. The former owner > could have made the sold machine legal by handing over the OS media that > came with the Mac when new. Then either the former owner or the buyer makes > the machine legal by reloading that original OS. So what you're saying is that the machine must be downgraded to it's original OS when sold as used, and then the purchaser is required to purchase upgraded system software? What about the machines that have processor upgrades performed to them? They're no longer the same machine that Apple made/sold in the first place, what OS should be put on them? > Question: What about buying the latest version of an OS, say X 10.1 and > 9.2, to replace the original OS 8.5 on a Mac -- can I then use the 8.5 media > to load on another Mac? Or, can I sell it as a legal license? I should > think so. I've bought an entirely new, complete OS, not an "upgrade." The > word out there? What's the difference between a "totally new OS" and an "upgrade"? None besides terminology, you said it yourself. Updates are free, "upgrades" are totally new systems. You are contradicting yourself. You first say that the OS stays with the machine, they're legally bound together, and you cannot put another OS on that machine unless you PAY FOR IT FOR THAT SPECIFIC MACHINE. Now you're saying that it's okay to "hand down" an OS to another machine, because you paid for an upgrade for the machine that is handing down the OS. But you haven't paid Apple for a license to use it on the hand me down receiving machine! You can't have it both ways. But this is exactly my point. A buyer purchases a machine with an upgraded OS on it, happens to not get the physical disks for the OS, but the OS has been legally acquired and installed. Why should the buyer be obligated to uninstall the OS and acquire a new disk? It's already been paid for. You're confusing the OS product with it's delivery system, which is the CD. Just because you don't have the physical disk doesn't mean that the OS wasn't put on the machine legally. (for example it could have been destroyed in a fire and therefore the seller wasn't able to provide it). Anyhow, I've got to go put my kids to sleep. I'm keeping my OS installed on my machine, and will have no qualms about it. My biggest concern is if I should need to reinstall the OS one day. Guess I'll have to acquire a disk at that point :) Ron -- G-List is sponsored by <http://lowendmac.com/> and...
