FWIW: I have purchased many, many Macs and clones over the years. Every single one (with one exception) had an OS that would boot the machine installed. Some came with OS CDs; some had not even the keyboard. Consequently, I have multiple copies of many versions of the OS. (BTW: 8.5 seemed to be the most popular to include.) The one machine that came without an OS installed (and it was so advertised by the seller) was DOA. The motherboard was bad. The seller made good on it.
The normal assumption would be that since Apple sells no machine without an OS installed that the OS is ipso facto (by that very fact) part of the purchase. I understand that's not what the legal documents in the software licenses say (and who reads those things anyway--even when you click "Agree"--there was an article I read last week that made the point that the way they are written intends that they NOT be read), but the normal assumption of the average citizen-user would be that that's part of the deal. That's my two-cents' worth.
