You can't simply assume (speaking morally rather than legally) that if the
media isn't supplied with the Mac that the buyer or seller ipso facto are
thieves.
Other possibilities are that the install media were lost, fell behind a
bookshelf, mixed up with tax records in a shoebox or old music CDs in a
carton somewhere. Not everyone is careful with their stuff. It may have sat
neglected for months and it's paraphernalia dispersed by uncaring
parents/housemates/dogs/children. 
And within a year the new owner will probably want to upgrade the OS and
buy a full install anyway. Instead of a Mac gathering dust in a closet,
it's now generating more cashflow for Steve Jobs. Legally it's grey, but
morally I wouldn't lose a moment's sleep over using a machine with whatever
OS it came with.
