I'm inclined to argue that this is the one instance in which you can copy
another person's CD without _any_ legal or ethical repercussions (unless the
company is willing to provide you with a replacement media for a nominal fee
but how many companies are that ethical in their business practices?). You
paid for the media + licence but can no longer use it because the media
failed, therefore you should be able to obtain a copy to allow you to
continue using that for which you paid.
