This is a classic case of rats on a sinking ship, Mike. FS knows that it hasn't a cat in hell's chance of winning the case. This is simply so that they can create unnecessary headache for GW in the hope that v7 will be delayed. You talk about the argument being on a point of law. Any lawyer worth his salt would know that the action is a nonstarter. FS is simply using its size to make life difficult for GW.

It's a shame that suits like this seem to rear their ugly heads, but it
