Indeed, this is the other thing I was thinking about.  My previous post
did not even take into consideration the various plugin/mod/hook ways you
could forcibly modify the max player slots on a server.  As others have
said, if somebody really wants to change the value a way will be found to
do it.  Once upon a time TF2 was locked at 24 and mods like beetlemod were
the only way to  get past it.

But asking the software company to lock the dedicated server's maxplayers
setting to some value, or make maxplayers have more "teeth" so your
customers "can't" rip you off is asking them to do your job for you.  This
is just my opinion but if you as a GSP don't know enough about the games
you are charging money to serve then you probably shouldn't be charging
money for your service.
