Sellers who don't qualify and monitor their clients and don't have a solid, contractual TOS are asking for trouble. The Lycos tactic is that "trouble".


"short time" abuse would mean short time counter-abuse, no permanent damage, the punishment fits the crime.

This collateral damage concept comes up every once in a while.  I think most
people would take a different view of this if they were the ones put out of
business as a result of the "collateral damage".

What %age of companies have been been put out of business due to collateral damage vs all the companies that have suffered collateral damage? Not doing the Lycos screensaver for this reason is FUD.


I consider myself "collateral damage" every time I fly and have to put up with airport security due to what terrorists did 3 years ago. ie, there is no presumption of civility and good faith. I am suspected of being a terrorist until proven innocent by security checks.

It's all fine and good until it happens to you...

And if it happens to you, you'll make darn sure to get it fixed quick and darn sure to minimize possibilities of CD to you in the future. The whole idea that we can't counter-attack spammers in self-defense because of hypothetical CD is bogus. The damage done to SMTP globally by spammers far outweights such CD.
