If you consider that every person on this list is a member of the 
"FOUNDATION", then the license HAS been written by the OGF. I 
cannot recall tha number of times that Ryan has posted the license 
for the people on this list to review the wording and hash out any 
potential problems with it. All of us working together have effectively 
written it together.

The fact that Ryan has then taken our efforts to WOTC's lawyers to 
make sure that what we worked together for  is legally correct, has 
very little bearing on that fact the we wrote the original text together.

Now, the license needs to be copyrighted, so that nobody can 
come along and make changes to the OGL that nullify/change 
portions of the OGL illegally. Since the d20 SRD is based on 
WOTC's main rpg product, I find no problems with the license being 
copyrighted to them.

Once the OGF is incorporated into an official entity, then I would 
hope that WOTC would transfer copyright to the OGF, but that is 
not really a big deal to me either way.
