This statement is based on the perceived fact (perceived by me) that the 
foundation is aware of customer confusion on this issue and takes no action 
to correct that confusion.

This is de-facto "intentional".  I explained this reasoning in an earlier 
e-mail.

A smaller (and less rational) rationale is, HOW COULD so many of the 
"rationales" I provided be correct, with NO EVIDENCE of ANY effort to fix 
the situation, WITHOUT there being some intent to deceive.

A matter of perception.
