Note that the *d20* and the *OGL* are not the same thing at all.  The d20STL 
was created for exactly the purpose that Brad mentioned above.  Ryan has 
been upfront about this throughout the entire process.  The OGL was created 
to support the d20STL, but is also a mechanism that is used to satisfy 
Ryan's personal and professional belief in open systems (if I may 
paraphrase).

Note that your example (PHB clone in different words) is still possible 
under the OGL.  What isn't possible, and rightly so, is to do it under the 
d20STL.  People keep forgetting these are different beasts.
